By IT HVAR. IT HVAR breaches this Agreement if: o IT HVAR institutes or has instituted against it insolvency, receivership or bankruptcy proceedings, makes an assignment for the benefit of creditors, or ceases doing business on a regular basis; o IT HVAR no longer holds a license or certificate that is required for IT HVAR to perform IT HVAR’s obligations under this Agreement; or o IT HVAR commits any breach of any covenant, warranty, obligation or certification under this Agreement, provided however that IT HVAR may cure the breach within30 calendar days after delivery of the notice or within such other period specified in DASPS’ notice of default.
