Cabin Crew Personal Effects – Loss or Damage. The Company shall reimburse Cabin Crew for Loss or Damage incurred to personal effects or baggage to a maximum of $2,468.00 while on duty, however this excludes money, jewellery and will be limited to a maximum of $150.00 for sunglasses. Permanent loss is deemed to have occurred if such personal effects or baggage have not been recovered within 40 days from the date of loss. Any such entitlement will not apply to circumstances in which compensation is payable under passenger liability provisions. Where a payment has been made and the personal effects or baggage is subsequently recovered, the Company will be entitled to reimbursement of the payment made. 55 SALARY PACKAGING Cabin Crew may with the Company agreement package part of their base salary. Any Fringe Benefits Tax and administration costs incurred as a result of the salary packaging arrangement will be met by Cabin Crew, on a salary sacrifice basis.

  • Loss or Damage Lessee hereby assumes and shall bear the entire risk of any loss, theft, damage to, or destruction of, any unit of Equipment from any cause whatsoever from the time the Equipment is shipped to Lessee.

  • Assignment Liability Indemnity Force Majeure Consequential Damages and Default Notwithstanding any other provision of this Agreement, the liability, indemnification and insurance provisions of the Transmission Operating Agreement (“TOA”) or other applicable operating agreements shall apply to the relationship between the System Operator and the Interconnection Transmission Owner and the liability, indemnification and insurance provisions of the Tariff apply to the relationship between the System Operator and the Interconnection Customer and between the Interconnecting Transmission Owner and the Interconnection Customer.

  • Damage to Personal Property The Employer will provide reimbursement for reasonable repair or replacement of damages incurred to the employee's eyeglasses, contact lenses or other prosthesis, ripped uniforms, or personal clothing, as a result of being assaulted while performing his/her work. The employee must report the incident by the end of their shift. The employee will present her or his receipt to the Employer within seven (7) days after the event, unless it was impossible for her or him to do so during this period. The Employer will reimburse up to a maximum of one hundred dollars ($100) per incident except for eyeglasses, which shall have a maximum reimbursement of three hundred dollars ($300).

  • No Special Damages In no event shall either party be liable hereunder (whether in an action in negligence, contract or tort or based on a warranty or otherwise) for any indirect, incidental, special or consequential damages incurred by the other party or any third party, even if the party has been advised of the possibility of such damages.

  • Disclaimer of Indirect Damages To the extent permitted by law, neither Party will, under any circumstances, be liable to the other Party or to any third party for indirect, consequential, incidental, special, or exemplary damages, or for lost profits or loss of business arising out of or related to the Agreement, even if the Party is apprised of the likelihood of such damages occurring.
