Common use of CABLE SYSTEM, TECHNICAL STANDARDS AND TESTING Clause in Contracts

CABLE SYSTEM, TECHNICAL STANDARDS AND TESTING. 11.1 Subscriber Network (A) Prior to the Effective Date of this Franchise, the parties acknowledge that Grantee undertook a voluntary upgrade of its Cable System to a hybrid fiber coaxial (HFC) fiber-to-the- node system architecture, with Fiber Optic cable deployed from its Headend to nodes and tying into a coaxial system serving Subscribers. The Cable System is now and shall throughout the term of this Franchise, deliver high quality signals that meet or exceed FCC technical quality standards regardless of any particular manner in which the signal is transmitted. (B) Equipment must be installed so that all closed captioning programming received by the Cable System shall include the closed caption signal so long as the closed caption signal is provided consistent with FCC standards. Equipment must be installed so that all local signals received in stereo or with secondary audio tracks (broadcast and Access) are retransmitted in those same formats. (C) All construction shall be subject to the City’s permitting process. (D) Grantee and the City shall meet, at the City’s request, to discuss the progress of the design plan and construction. (E) Grantee will take prompt corrective action if it finds that any facilities or equipment on the Cable System are not operating as expected, or if it finds that facilities and equipment do not comply with the requirements of this Franchise or Applicable Law. (F) Grantee’s construction decisions shall be based solely upon legitimate engineering decisions and shall not take into consideration the income level of any particular community within the Franchise Area.

The Cable System shall throughout be capable of delivering no less than two hundred (200) Channels of digital Video Programming services to Subscribers, provided that the term of this Franchise, deliver high quality signals that meet or exceed FCC technical quality standards regardless of any particular manner Grantee reserves the right to use the bandwidth in which the signal is transmittedfuture for other uses based on market factors. (B) Equipment must be installed so that all closed captioning programming received by the Cable System shall include the closed caption signal so long as the closed caption signal is provided consistent with FCC standards.
