Common use of CALL OFF PROCEDURE Clause in Contracts

CALL OFF PROCEDURE. 5.1. If the Authority or any Other Contracting Body decides to source any of the Goods and/or Services through this Framework Agreement, then it shall be entitled at any time in its absolute discretion during the Framework Term to award Call Off Agreements by following the Further Competition Procedure in Framework Schedule 5 (Call Off Procedure). 5.2. The Supplier acknowledges that it is anticipated that the Authority will be administering Further Competition Procedures on behalf of the majority of Other Contracting Bodies in respect of their Goods and/or Services Requirements under the Framework, although some Other Contracting Bodies may administer separate Further Competition Procedures in respect of their own Goods and/or Services Requirements. 5.3. For the avoidance of doubt, where the Authority administers Further Competition Procedures on behalf of Other Contracting Bodies, any resultant Call Off Agreement will be between the Supplier and the individual Other Contracting Body. The Authority will not be party to, nor have any involvement in the management or administration of (any Call Off Agreement involving Other Contracting Bodies, save where expressly mentioned in Framework Schedule 1 (Goods and/or Services and Key Performance Indicators) and the Template Call Off Terms (as these may be refined by a Contracting Body under the Further Competition Procedure). 5.4. The Supplier shall comply with the relevant provisions in Framework Schedule 5 (Call Off Procedure).
