City shall have the option to suspend Developer or Developer’s contractor’(s) performance should there be a lapse in coverage at any time during this Agreement. Failure to provide and to maintain the required insurance shall constitute a breach of this Agreement and the City may exercise any and all available legal remedies.

  • Cancellations and Refunds Our cancellation policy is as flexible and understanding as possible. All our bookings are received well in advance of trip departures and other people may have been turned away because kayaks have been reserved. Cancellations due to weather will be determined by a Saltwater Soul associate on the day of your reservation. If cancellation is due to weather or safety concerns, we will attempt to rebook you. You will be issued a full refund if you are unable to rebook. All cancellations by guest need to be made 24 hours in advance for a full refund. Cancellations made less than 24 hours from reservation will result in a 50% refund.

  • Cancellation of Agreement In the event that prior to the Closing Date (a) trading in securities on the New York Stock Exchange generally, or in securities of the Bank in particular, shall have been suspended, or minimum prices established by the New York Stock Exchange, or any new restrictions on transactions in securities shall have been established by the New York Stock Exchange or by the Commission or by any other United States Federal or State agency or by any action of the United States Congress or by executive order to such a degree as, in your judgment as the Representatives, to affect materially and adversely the marketing of the Securities or (b) existing financial, political or economic conditions in Europe, the United States or elsewhere shall have undergone any change which, in your judgment as the Representatives, would materially and adversely affect the market for the Securities, this Agreement and all obligations of the Underwriters hereunder may be canceled at, or at any time prior to, the Closing Date by you, as the Representatives, without liability on the part of any Underwriter to the Bank or of the Bank to any Underwriter, subject to Section 11(e). Notice of such cancellation shall be given to the Bank in writing, or by cable or telephone confirmed in writing.

All cancellations will become effective as of the date of the postmark or email receipt. All requests for refunds must be sent to Air Journey in writing via mail, fax or email.   • Cancellation by You 5.1. If you wish to cancel your Booking for whatever reason, you must confirm in writing to us that. Your cancellation will come into effect on the date that we receive your written confirmation that your Booking has been cancelled. 5.2. If you cancel your Booking, the cancellation fees will include the total Scheduled Payments due to us for your Booking by the date of cancellation. You agree to pay us any Scheduled Payments that are due but unpaid at the point that you cancel your Booking. 5.3. In addition to the cancellation fees in clause 5.2, depending on the period of time between our receiving your written instruction to cancel your booking and the date of the event, you will owe the following cancellation fees: 5.3.1. £2,000 (excluding VAT) if we receive your written instruction to cancel less than 3 calendar months but more than 8 weeks before the date of the event, or; 5.3.2. the balance showing on the final catering invoice if we receive your written instruction to cancel at or less than 8 weeks before the date of the event and the final invoice has been issued. 5.4. Notwithstanding clauses 5.2 and 5.3 , if at any time we receive a replacement Booking for the cancelled date following cancellation by you, we will refund to you any Catering Fees and cancellation fees we have received from you, less the Cancellation Costs. 5.5. It is your responsibility to notify your Suppliers of any cancellation. Please note that notifying your Suppliers of a cancellation does not cancel your Booking. 5.6. Upon cancellation of your Booking, we will issue an invoice to you for any amounts due in accordance with this clause 5 which shall be payable within 14 days of the date of the invoice. Any subsequent refunds due to you pursuant to clause 5.4 will then be made within 14 days by us following completion of the event for a replacement Booking.

  • Termination and Renewal This Agreement shall be in full force and effect until December 31, 2021, and shall continue in effect from year to year thereafter unless either party gives notice, in writing, at least sixty (60) days prior to any expiration or modification date of its desire to terminate or modify such Agreement; provided that, in the event the Union serves written notice in accordance with this Section, any strike or stoppage of work after any expiration or modification date shall not be deemed in violation of any provision of this Agreement, any other provision to the contrary notwithstanding.
