Capacité. 1. Chaque Partie donne aux entreprises de transport aérien désignées par l’autre Partie des chances égales de fournir les services aériens convenus sur les itinéraires indiqués. 2. Chaque Partie permet à l’entreprise ou aux entreprises de transport aérien désignées par l’autre Partie de déterminer, en fonction des conditions commerciales du marché, la fréquence et la capacité des services de transport aérien internationaux qu’elles proposent. Il s’ensuit qu’aucune des Parties ne limite unilatéralement le volume du trafic, la fréquence ou la régularité des services et le ou les types d’aéronefs exploités par les entreprises de transport aérien désignées de l’autre Partie, sauf si des considérations douanières, techniques, opérationnelles ou écologiques l’exigent dans des conditions uniformes qui respectent les dispositions de l’article 15 de la Convention.

Capacité. Le Vendeur peut fournir à l’Acheteur des estimations ou des prévisions sur sa capacité de production ou de livraison des Produits. L’Acheteur reconnaît que toute estimation ou prévision n’est fournie qu’à titre d’estimation de la production et que, comme toute autre projection prospective, elle se base sur un certain nombre de facteurs, de variables et d’hypothèses d’ordre économique et commercial, certains desquels voire tous pourraient changer avec le temps. Le Vendeur ne livre aucune déclaration, garantie, assurance ou engagement, qu’ils soient exprès ou tacites, concernant toute estimation ou prévision fournie à l’Acheteur, y compris au regard de la précision ou du caractère complet de l’estimation ou de la prévision.
Capacité. 1. Les entreprises de transport aérien désignées des deux Parties Contractantes bénéficieront de possibilités justes et égales dans l'exploitation des services convenus entre leurs territoires respectifs et au-delà, sur les routes spécifiées dans l'Annexe au présent Accord. 2. Dans l'exploitation des services convenus, l'entreprise de transport aérien désignée par l'une des Parties Contractantes tiendra compte des intérêts de l'entreprise de transport aérien désignée par l'autre Partie Contractante, de façon à ne pas xxxxxx indûment atteinte aux services que celle-ci assure sur la totalité ou sur une partie de la même route. 3. Les services convenus assurés par les entreprises de transport aérien désignées par les Parties Contractantes auront un rapport raisonnable avec les besoins du public en matière de transport sur les routes spécifiées et auront pour objectif principal d'assurer, selon un coefficient de charge utile raisonnable, une capacité suffisante pour répondre aux besoins courants et normalement prévisibles en matière de transport des passagers, des marchandises et du courrier entre les territoires des Parties Contractantes. 4. Les entreprises de transports aériens désignées soumettront pour approbation, au plus tard 30 jours avant le début de l'exploitation d'un service convenu, les programmes d'exploitation aux autorités aéronautiques des deux Parties Contractantes. Ces programmes d'exploitation comporteront notamment le type de service , les types d'aéronefs, les fréquences de service et les horaires de vols. Ceci s'applique également pour toute modification ultérieure. Dans des cas particuliers xx xxxxx pourra être réduit, moyennant le consentement desdites autorités.

Chaque partie contractante offre aux entreprises de transport aérien désignées des deux Parties contractantes des occasions égales et équitables pour l’exploitation des services convenus sur les routes spécifiées dans le présent accord. 2. Chaque Partie contractante permet à toute entreprise de transport aérien désignée de l’autre Partie contractante de déterminer la fréquence et la capacité des services convenus qu’elle offre en fonction de ses considérations commerciales sur le marché. En conséquence, ni l’une ni l’autre des Parties contractantes n’ impose à une entreprise de transport aérien désignée de l’autre Partie contractante d’exigence en fait de capacité, de fréquence ou de trafic qui serait incompatible avec les objectifs du présent accord. Ni l’une ni l’autre des Parties contractantes ne limite unilatéralement le volume de trafic, la fréquence ou la régularité de service, ou le ou les types d’aéronefs exploités par une entreprise de transport aérien désignée de l’autre Partie contractante, sauf dans la mesure où cela est nécessaire aux fins des douanes ou d’autres services d’inspection gouvernementaux ou pour des motifs d’ordre technique ou opérationnel à des conditions uniformes et conformes à l’article 15 de la Convention. 3. Les autorités aéronautiques d’une Partie contractante peuvent exiger, à des fins informatives, le dépôt d’horaires ou d’indicateurs au moins trente (30) jours avant la prise d'effet de nouveaux services ou de services révisés, ou dans le délai plus bref qu’elles déterminent. Si les autorités aéronautiques d’une Partie contractante exigent le dépôt de documents à des fins informatives, elles minimisent le fardeau administratif des exigences et des procédures en matière de dépôt pour l’entreprise de transport aérien désignée de l’autre Partie contractante.

  • Capacity IET systems are monitored to optimize the use of resources and to control costs. Where services are hosted by external service providers (outsourced), agreements are in place to monitor capacity and performance. A loss of availability from causes which are beyond the control of IET is excluded from the availability warranty. This includes but is not limited to, acts from natural events such as earthquakes, storms, natural flooding, and wild fires. Also excluded are police actions, interruptions due to protest events, labor disputes, war, pandemic, terrorism, riots, and/or inability to obtain energy. Each party must provide prompt notice of service disruptions. Services will resume as soon as possible. Either party will take all reasonable steps to remove the causes of unavailability and resume services as soon as reasonably possible. IET will provide the availability status of major services on the IET status page. The status page is located at xxxx://xxxxxx.xxxxxxx.xxx/ Managed campus-wide systems, applications and services may be subject to the formal IET Change Management process. Changes to services may be required by system maintenance needs, corrective actions to resolve incidents, or service improvement projects. Changes may require adherence to change management policies including formal authorizations, approvals, peer reviews, risk assessments and lead times for notifying Customers and scheduling changes. IET notifies Customers about planned technology systems are changes that may have a risk of directly or indirectly impacting IET services. Information and Educational Technology shall be responsible for ensuring that reasonable skill, care and diligence are exercised in carrying out the services properly and efficiently in accordance with this service level agreement. Transnational data and information supplied by the Customer or its clients are owned by the Customer. IET serves as custodian of these data and will take measures to house, backup and protect the data for the Customer, consistent with the services, and as appropriate. Customer agrees to use and pay for the services in accordance with the terms of this agreement and in compliance with any overarching UC Xxxxx policies. Customer agrees to take appropriate steps to ensure compliance with The UC Xxxxx Cyber-safety Policy and UC Xxxxx Security Standards Policy (PPM Section 310-22). Customer agrees not to engage in actions or activities that circumvent, compromise, or introduce risks to the policy, standards or the controls established to ensure cyber security compliance. Customer is responsible for costs which result from improper use of the services and which cause damage or loss to IET or its Customers.

  • INDEPENDENT CAPACITY The employees or agents of each party who are engaged in the performance of this Agreement shall continue to be employees or agents of that party and shall not be considered for any purpose to be employees or agents of the other party.

  • Capacity/Independent Contractor In providing the Services under this Agreement it is expressly agreed that the Contractor is acting as an independent contractor and not as an employee. The Contractor and the Client acknowledge that this Agreement does not create a partnership or joint venture between them, and is exclusively a contract for service.

  • Capacity as Lender The Person serving as the Administrative Agent hereunder shall have the same rights and powers in its capacity as a Lender as any other Lender and may exercise the same as though it were not the Administrative Agent, and such Person and its Affiliates may accept deposits from, lend money to and generally engage in any kind of business with the Borrower or any Subsidiary or other Affiliate thereof as if it were not the Administrative Agent hereunder.

Each Lender acknowledges that, pursuant to such activities, LaSalle or its Affiliates may receive information regarding the Company or its Affiliates (including information that may be subject to confidentiality obligations in favor of the Company or such Affiliate) and acknowledge that the Administrative Agent shall be under no obligation to provide such information to them. With respect to their Loans (if any), LaSalle and its Affiliates shall have the same rights and powers under this Agreement as any other Lender and may exercise the same as though LaSalle were not the Administrative Agent, and the terms “Lender” and “Lenders” include LaSalle and its Affiliates, to the extent applicable, in their individual capacities.

  • Agent in Its Individual Capacity Each Agent and its affiliates may make loans to, accept deposits from and generally engage in any kind of business with any Loan Party as though such Agent were not an Agent. With respect to its Loans made or renewed by it and with respect to any Letter of Credit issued or participated in by it, each Agent shall have the same rights and powers under this Agreement and the other Loan Documents as any Lender and may exercise the same as though it were not an Agent, and the terms “Lender” and “Lenders” shall include each Agent in its individual capacity.
