CDMA Laptop Cards. Notwithstanding anything in this Agreement to the contrary, with respect to CDMA laptop cards (and related software), the Operating Company may distribute “EarthLink Wireless” branded CDMA laptop cards and “EarthLink Total Access” access software, which shall be the exclusive card and software distributed by the Operating Company, during the period (the “Exclusivity Period”) that begins on the date hereof and ends on the earlier to occur of (i) the date on which EarthLink or a Subsidiary of EarthLink ceases to owns a share of Class B Common Stock or (ii) the second anniversary of the date hereof. Following the expiration of the Exclusivity Period, the Operating Company and its Subsidiaries shall be permitted to market and distribute any CDMA laptop cards and related software.

  • Company Products Schedule 2.10(d) of the Company Disclosure Letter lists all Company Products, and for each such product or feature (and each version thereof) identifying its release date.

  • Computers All computers, hardware, software, computer upgrades and maintenance in connection therewith shall be at Owner's expense.

  • Cell Phones The College follows the State’s Cell Phone Policy. Employees who receive cell phones from the College shall also abide by this Policy. The College shall provide the Policy to any employee who is given a cell phone. Employees are responsible for the cost of all personal calls. While the College anticipates some incidental personal use of cell phones, it is also expected that such use is infrequent.

  • Computer Equipment Recycling Program If this Contract is for the purchase or lease of computer equipment, then Contractor certifies that it is in compliance with Subchapter Y, Chapter 361 of the Texas Health and Safety Code related to the Computer Equipment Recycling Program and the Texas Commission on Environmental Quality rules in 30 TAC Chapter 328.

  • Software Inclusions Restrictions

  • Software Products Save as otherwise set forth in the Agreement, the right to use any Software Product is personal to the Licensee, for its own internal use, and is non-transferable, except with the Licensor’s prior written consent, in which case the Licensee shall cause the assignee or sub-licensee to agree to the terms of this Software License.

  • Programming Processor is not responsible for programming or reprogramming of fuel dispensers.

  • Antivirus software All workstations, laptops and other systems that process and/or store PHI COUNTY discloses to CONTRACTOR or CONTRACTOR creates, receives, maintains, or transmits on behalf of COUNTY must have installed and actively use comprehensive anti-virus software solution with automatic updates scheduled at least daily.
