Common use of Certification of Product Clause in Contracts

Certification of Product. During the Delivery Term, Seller shall[, or shall cause the Project Company to], at no cost to Buyer, obtain and maintain CAISO and all applicable Governmental Authority certification(s) for all elements of the Product for which certification is or may become required in order to enable Buyer to receive and use such Product, including use of such Product to satisfy its Compliance Obligations. If Buyer is required under applicable Law to obtain such certification, Seller shall[, or shall cause the Project Company to,] take all actions within its control to ensure that Buyer is able to secure such certification. Seller shall[, or shall cause the Project Company to], at no cost to Buyer, take all other actions during the Delivery Term, including submission of all reports and other filings with CAISO and applicable Governmental Authorities, that are required to be taken by Seller [or Project Company] to ensure that Buyer can receive the Product and shall take all actions within its control to assist Buyer in taking actions required to be taken by Buyer with regard to receipt of Product.
