Cessation of Use of Premises at End of Agreement Term. Upon the termination of this Agreement, Contractor shall cease its use of the Premises and all Alterations, additions and improvements thereto, and shall surrender the Premises in the same condition as when received, ordinary wear and tear and damage by fire, earthquake, act of God, or the elements excepted. All Alterations and any other improvements installed in the Premises by Contractor (other than Contractor’s trade fixtures), shall, without compensation to Contractor, then become City’s property free and clear of all claims to or against them by Contractor or any third person. In the event that Contractor shall fail to remove its personal property, including trade fixtures, such personal property shall become City’s property free and clear of all claims to or against them by Contractor or any third person. In such event, City shall not be responsible for any losses related to such personal property, and City may sell or otherwise dispose of such personal property at the sole cost and expense of Contractor.
