Changes in Scope of Project or Maintenance Services. If an event or situation occurs that may entitle DB Contractor to a Change Order increasing the Maintenance Price, TxDOT will evaluate the situation and shall have the right, in its discretion, to make changes to the definition of the Project or the scope of Maintenance Services so as to bring it within TxDOT’s funding and time restraints.
