Routine Maintenance. (i) CRC shall be responsible for Routine Maintenance when necessary or desirable to maintain the Shared Assets in a safe operating condition, and to permit and facilitate (A) the performance by CRC of its obligations pursuant to this Agreement, and (B) the use of Shared Assets by the Operators in accordance with this Agreement.
(ii) CSXT or NSR, directly or through their respective affiliates, may perform the work which CRC performed prior to the date of this Agreement when (A) CRC does not possess the skills needed for such work, (B) CRC lacks the necessary employees to do such work in a timely fashion, or (C) CRC does not possess the equipment needed to do such work. CRC and the party performing the work shall agree to a reasonable fee for such work prior to performance. CRC, CSXT and NSR may agree to have additional work performed either by CSXT, NSR or their affiliates.
Routine Maintenance. Tenants are responsible for normal household maintenance, including replacement of light bulbs, fuses; and cleaning of carpets, sinks, commodes, etc.
Routine Maintenance. A. Party of the First Part will perform the following routine maintenance: Street sweeping
B. Party of the First Part will perform the above described routine maintenance in compliance with the Iowa Department of Transportation’s standard maintenance policies and procedures which include, but are not limited to, the Department’s standards for maintenance activities and instructional memorandums. Particularly, Party of the First Part shall comply with: Not applicable
C. Party of the Second Part will perform the following routine maintenance: Not applicable
Routine Maintenance. During the Term, WinStar shall perform all required Routine Maintenance Services at the charges set forth in Schedule C. "
Routine Maintenance. Licensor shall be responsible for the routine maintenance of Licensed Software. Licensor shall undertake the foregoing obligation in a commercially reasonable manner and in a manner designed to minimize interruption to the Business. To the extent any scheduled maintenance of the Licensed Software would cause a material interruption to the operation of the Business of Licensee, Licensor shall inform Licensee at least thirty (30) days prior to such maintenance and shall complete such maintenance as promptly as practicable.
Routine Maintenance. During the Easement Term, once the Trails are installed, KAI shall cause the Trails to be repaired and maintained, including without limitation the making of all surface and subsurface repairs and maintenance, seal coating and removal of trash, rubbish and other refuse, if any, so as to maintain such Trails in good condition, reasonable wear and tear excepted, in a professional manner that is reasonably acceptable to each of the parties. The cost of the maintenance shall be split evenly between the City and KAI.
Routine Maintenance. During the Easement Term, once they are installed, the City as to the Recreation Center Site and KAI as to the Stadium Site, shall at their respective expense cause the curbs and paving in the parking lots and access drives included in the Access and Parking Areas to be repaired and maintained, including without limitation the making of all surface and subsurface repairs and maintenance, line painting, seal coating and removal of trash, rubbish and other refuse, if any, so as to maintain such parking lots and access drives in good condition, reasonable wear and tear excepted, in a professional manner.
Routine Maintenance. During the Easement Term KAI shall cause, and shall pay or cause a third party other than RCP or the City to pay the costs and expenses of, the maintenance of all landscaping on the Property (the “Landscape Areas”) in a professional manner including proper mowing, trimming and edging appropriate for the area, and reasonably acceptable to the City and RCP.
Routine Maintenance. During the IRU Term, Xxxxxxxx shall perform all required Routine Maintenance at no additional cost to WinStar. "
Routine Maintenance. Routine Maintenance is maintenance and repairs that Pilot deems necessary to ensure proper functioning of the network, Pilot, including by and through its agents or subcontractors, shall perform routine and preventative maintenance, including route patrol and all cable and locate activities as a part of the local “Call Before You Dig” program. Planned network maintenance that does or does not potentially involve the disruption of functionality of the Dark Fiber Service is also considered Routine Maintenance. The nature of such a planned Routine Maintenance activity is such that it can be pre-scheduled so as to allow notification to Customer as appropriate. The Pilot NOC will generally schedule such planned Routine Maintenance outside normal working hours anytime between 12:00 AM to 6:00 AM (local time) seven (7) days a week. Pilot will provide Customer with ten (10) business days prior notice of Routine Maintenance that is service affecting and five (5) business days prior notice of Routine Maintenance that is not service affecting. All maintenance other than Routine Maintenance as described above shall be deemed to be Non-Routine Maintenance.
