Changes to Operations. Changes to the operating procedures shall be accomplished through revision to the SOP. Each approved SOP change shall be deemed to be automatically incorporated into the Agreement by reference without need for a contract amendment upon the Director’s written approval in accordance with Section 4.6.4.
Changes to Operations. As the result of a Performance Review, the City reserves the right to require reasonable changes to the Contractor's operations which the City determines to be necessary or appropriate to bring them into compliance with the terms and conditions of this Agreement.

In conjunction with a particular Performance Review, the City reserves the right to require changes to the Contractor's operations, which the City determines to be necessary or appropriate by reason of the findings or results of the Performance Review to carry out the intent of the terms and conditions of this Agreement, or to modify the Contractor’s Rates pursuant to Article 6. Prior to unilaterally requiring any changes in accordance with this Article, Contractor shall have the right to cure, or demonstrate the ability to cure such performance issues identified. Changes in operations necessary to insure satisfactory performance under this Agreement shall not constitute a basis for Contractor requesting a Rate adjustment.
