Common use of CHANGES TO SCOPE OF SERVICES Clause in Contracts

CHANGES TO SCOPE OF SERVICES. 6.1 The City’s Project Manager may, from time to time and at any time on prior written notice to the Consultant, vary the scope of Services to be provided by the Consultant. In that case and where this Agreement contains delivery dates and/or limits as to the Maximum Fees and Disbursements to be paid to the Consultant pursuant to Section 5.3 for all or any part of the Services, such delivery dates and/or limits will be adjusted as agreed to by both Parties in writing, and failing agreement, as reasonably determined by the City’s Project Manager. 6.2 Should the Consultant consider that any request or instruction from the City’s Project Manager constitutes a change in the scope of Services, the Consultant will provide the City’s Project Manager with notice in writing within ten days of such request or instruction. If the Consultant does not deliver written notice to the City within the time period specified, the City will not be obligated to make any payments of additional fees, disbursements or out of pocket expenses to the Consultant.
