Common use of City Wastewater Service Clause in Contracts

City Wastewater Service. The City will become the exclusive provider of wastewater collection and treatment service to the Development through the City’s System in an amount up to 10 LUEs. The City will make this retail wastewater service available to the Land upon (a) Owner’s construction and connection of the Onsite and Offsite Facilities pursuant to this Agreement, and (b) the City’s delivery of a notice in writing that the City’s System has capacity to begin receiving wastewater pursuant to this Agreement. Additional LUEs will not be made available to the Land or to the Development except as may be agreed in writing by the City from time to time.

The Notwithstanding anything contained in this Agreement to the contrary, City will become be the exclusive provider of wastewater collection and treatment service to the Development through the City’s System or the Package Plant in an amount up to 10 531residential LUEs, 8 amenity center LUEs and 32 commercial/governmental/utility/institutional LUEs. The City will make this retail wastewater service available to the Land upon (a) Owner’s construction and connection of the Onsite and Offsite Facilities pursuant to this Agreement, and (b) the City’s delivery of a notice in writing that System or the City’s System has capacity to begin receiving wastewater Package Plant pursuant to this Agreement. Additional LUEs will not be made available to the Land or to the Development except as may be agreed in writing by the City from time to time.
