CIVIL SERVICE RULES. Nothing in Section 1 and 2 of this Article shall limit the Director of Human Resources or the appointing authority’s discretion to implement layoffs pursuant to Civil Service Rules.

CIVIL SERVICE RULES. The parties agree that unless specifically addressed herein, those terms and conditions of employment which are currently set forth in the Civil Service Rules shall continue to apply to employees covered by this contract. No matter set forth in the Civil Service Rules shall be subject to the grievance procedure. Changes to the Civil Service Rules may be proposed during the terms of this contract subject to meet and confer as appropriate. Changes to the Civil Service Rules shall not be subject to arbitration.
CIVIL SERVICE RULES. The parties to this Agreement expressly recognize that certain terms and conditions of employment are governed by the Rules of the City of Minneapolis Civil Service Commission and that the Rules of the City of Minneapolis Civil Service Commission, except where specifically superseded by this Agreement, shall be considered to be part of this Agreement. Both parties agree that they will abide by those Rules for the term of this Agreement and any extensions thereof. The parties agree that if the Civil Service Commission changes or adds to its Rules in such a way as to conflict with any express provision of this Agreement, the terms of this Agreement shall prevail. In the event that the Board of Education xxxxxx its ties to the City of Minneapolis Civil Service Commission, the Civil Service Rules as most recently in effect prior to severing of such ties shall remain in full force and effect.
CIVIL SERVICE RULES. The administrative and procedural provisions and controls of Civil Service Law and the Rules and Regulations promulgated thereunder, are to be observed in the administration of this Agreement, except to the extent that this Agreement pertains to subjects not therein contained or where this Agreement is contrary to, or in conflict with such provisions and controls and deviation from such rule or control is statutorily permitted. Nothing herein shall be construed to deny any individual employee his rights under the Civil Service Law or Regulations. This Article does not apply to the unclassified service.

CIVIL SERVICE RULES. The parties agree to meet and confer on all proposed Civil Service Rule changes within the scope of bargaining during the term of this agreement. It is agreed that any required negotiations over the proposed rule changes shall be concluded with the Union prior to presentation of proposed rule changes to the APCD Board.

CIVIL SERVICE RULES. By entering into this Agreement, the Parties recognize and agree that the provisions of this Agreement shall take precedence over Civil Service law provisions, including the applicable sections of Chapters 142 and 143 of the Texas Local Government Code, or the Local Rules, whenever the provisions of the Agreement specifically addressed them. All other statutory provisions contained in Chapters 142 and 143 of the Texas Local Government Code and the Local Rules, not in conflict herewith, shall remain in full force in the same manner as on the date this agreement became effective.
CIVIL SERVICE RULES. I. For purpose of this MOU, the Civil Service Rules are incorporated as reference as though set out in full in this article. II. The City agrees to maintain a current eligibility list for Battalion Chief, Captain, and Fire Engineer. The Fire Department shall, in its sole discretion, determine the manner to keep an eligibility list current -- either by promulgating a new list or by extending a current list. Should an eligibility list expire, the remedy shall be the expeditious promulgation of a new eligibility list.
CIVIL SERVICE RULES. The Civil Service Rules as existing on the date of the execution of this agreement, are now in force, agreed upon, and shall become, by reference, part of this MOU. In addition, those clarifications to the Civil Service Rules and Administrative Procedures Manual, as proposed by the CITY and attached to past Memorandum of Understanding, have been incorporated. It is agreed that in any instance where there is a conflict between material covered in this MOU and the Civil Service Rules, this MOU shall take precedence.
