CLASS 7328. EQUIPMENT OPERATION 245. Operation of such equipment as was enumerated under Class 7328 in the 1992-93 Salary Standardization Ordinance (is incorporated herein by reference) shall be performed by members of the bargaining unit. No part of the above shall be construed in any manner which interferes with the transport of vehicles, the movement of vehicles by mechanics, equipment managers or other appropriate personnel for the purposes of transport, repair, inspection, response to emergencies or other unusual circumstances as defined herein. The parties agree to meet regarding the establishment of exceptions. Should jurisdictional disputes arise, the parties agree to meet with all affected parties for the purpose of resolution. Nothing in this section shall conflict with charter provisions or Civil Service Commission’s rules.

No part of the above shall be construed in any manner which interferes with the transport of vehicles, the movement of vehicles by mechanics, equipment managers or other appropriate personnel for the purposes of transport, repair, inspection, response to emergencies or other unusual circumstances as defined herein. Should jurisdictional disputes arise, the parties agree to meet with all affected parties for the purpose of resolution. Nothing in this section shall conflict with charter provisions or Civil Service Commission’s rules. 245. The parties agree to continue to meet and confer regarding exceptions for the following equipment: Public Works current use of Multihog and Loaders, including those Loaders categorized as bobcats or skid steers, at Public Works with an operating weight of five tons or less and use of attachments. If an agreement on exceptions cannot be reached by January 30, 2023, the parties agree that arbitrator Xxxxxx Xxxxxx (or another mutually agreed upon arbitrator) retains jurisdiction to decide the outstanding issue pursuant to Charter Section A8.409.
