COD Notice. Seller shall notify Buyer immediately after Seller has achieved Commercial Operation that the Commercial Operation Date has occurred, which notice shall set forth the Commercial Operation Date, include reasonable evidence to Buyer of the satisfaction of all of the conditions set forth in Section 3.1 (to the extent not waived by Buyer in accordance with Section 19.8) and include a certification to that effect by an authorized officer of Seller familiar with the Facility after due inquiry.
