Common use of College-Sponsored Materials Clause in Contracts

College-Sponsored Materials. In those instances where materials, processes, or inventions are produced by a faculty member with College support by way of use of significant work time, facilities, or other College resources, the ownership of the materials, processes or inventions shall vest in (and be copyrighted or patented by, if at all) the person or persons designated by written agreement between the parties entered into prior to the production. The Association will be notified by the College when a written proposal to enter into an agreement has been made by a faculty member or members. In the event there is no such written agreement, the ownership shall vest in the College. Any disputes regarding such agreements shall be submitted to expedited arbitration utilizing the American Arbitration Association. The request for expedited arbitration may be made by either party if agreement has not been reached within thirty
