Committee. (a) There shall be a committee to address the planning of professional development initiatives for nurses as described in Article 9.01. This committee shall include representatives of the Hospital, one of whom shall be the Chief Nursing Officer or designate and another, a Human Resources representative; and of the Association, one of whom shall be the Bargaining Unit President or designate. The number of representatives is set out in the Appendix of Local Provisions. The Employer’s Vice President and the Union’s Co-Chair shall have the discretion to grant the grievant triple time pay for hours worked in excess of nine and one half (9.5) hours per day and/or to order the Employer to adjust the driver’s work schedule. After the forty-five (45) day Supplemental Co-Chair meeting, if anythere are continued violations the Co-Chairs shall have the discretion to grant quadruple time penalties as outlined in this section. In the event the Employer’s Vice President and the Union’s Co-Chair cannot resolve a grievance, unless otherwise agreedeither party may refer the matter to arbitration in accordance with Article 8. In the event the parties cannot resolve a dispute over whether excessive overtime in violation of this Section resulted from inadequate staffing in the center or other causes, such as the temporary unavailability of drivers, either may refer the matter to arbitration in accordance with Article 8. If the position of the Union is sustained, the arbitrator shall have the authority to award any remedy set forth in this Section including back wages at the appropriate rate of pay to the employee(s) adversely affected, as well as appropriate progression credit. The back wages shall be provided equal to Committee members. If the dispute cannot be resolved, either party may refer the matter to arbitration in accordance with Article 8, Section 7. The next arbitrator in rotation on nursing competencies including the budget and expenditures related eastern Panel shall be assigned the case. The arbitrator shall have the authority to nursing education. Through the Chief Nursing Officer, provide recommendations with respect to professional development initiatives award any remedy specified in the development paragraph above. The 9.5 committee shall also have the authority to ensure that this Section is implemented in such a way as to balance the Employer’s need to protect the integrity of the Hospital Operating Plan; ii) Reviewing the demographics of the nursing complement; iii) Developing guidelines for the development, implementation and evaluation of professional development initiatives; iv) Developing means its operations with an employee’s legitimate need to promote equal access to professional development opportunities including, but not limited to programs (such as conferences, seminars and workshops), funding, scheduling, leaves, mentoring roles and preceptorship; v) Reviewing and making recommendations regarding professional development initiatives, including but not limited to mentorship and internship; vi) Reviewing and making recommendations regarding the existing nursing continuing education programs; and on the use of technology to enhance access; vii) Developing and implementing an ongoing communication plan to advise nurses about the work avoid excessive overtime. Committee. This Committee is established to provide a Labor Management forum to discuss issues of a systemwide nature that affect Customer Field Service employees. The Committee will consist of seven members from the Union appointed by the Union's Business Manager and seven members appointed by the Company. A request by such a nurse for orientation shall not be unreasonably denied. Both the Hospital and the Association recognize their joint responsibility and commitment to provide, and to participate in, in-service education. The Association supports the principle of its members’ responsibility for their own professional development and the Hospital endeavour to provide programs relatedto the requirements of the Hospital. Available programs will be publicized, and the Hospitalwill endeavour to provide nurses with opportunities to attend such programs during their regularly scheduled working hours. When a nurse is on duty and authorized to attend any in-service program within the Hospital and during her or his regularly scheduled working hours the nurse shall suffer no loss of regular pay.
