Effect of Absence. Where any leave of absence without pay exceeds thirty (30) continuous calendar days, the following shall apply:
(a) The Employer shall pay its share of the health and welfare benefits for the calendar month in which the leave commences and in the month immediately following.
(b) If the leave of absence exceeds thirty (30) consecutive calendar days, benefit coverage may be continued by the employee, provided that she pays the total cost of the premiums to the Employer for each monthly period in excess of the thirty (30) consecutive calendar days leave of absence except as modified by (a).
(c) Benefits will accrue from the date of return to employment following such leave of absence.
(d) The employee's anniversary date for salary increases shall be adjusted by the period of time in excess of the thirty (30) continuous calendar days, and the new anniversary date shall prevail thereafter.
(e) Seniority, service, vacation credits or any other benefits under any provision of the collective agreement or elsewhere will not accumulate, but will remain fixed at the amount held at the commencement of the leave.
(f) Notwithstanding the above, the Employer shall continue to pay its share of the premium for the benefit plans for employees who are on paid leave of absence or WSIB, and will continue to pay its share of the premium for the benefit plans in accordance with the Employment Standards Act for employees who are on pregnancy/parental leave (currently a maximum of twelve (12) months) or family medical leave (currently a maximum of eight

(f) Notwithstanding the above, the Employer shall continue to pay its share of the premium for the benefit plans for employees who are on paid leave of absence or WSIB, and will continue to pay its share of the premium for the benefit plans in accordance with the Employment Standards Act for employees who are on pregnancy/parental leave (currently a maximum of eighteen (18) months) or family medical leave (currently a maximum of twenty-eight (28) weeks in a fifty-two (52) week period) or emergency leave (currently a maximum of three (3) unpaid sick leave days for personal illness, three (3) unpaid family responsibility leave days for family member illness or other urgent matters, and two (2) unpaid bereavement leave days per year). It is understood that the obligation of the Employer to pay its share of the health and welfare benefits while an employee is on WSIB shall continue only so long as the employment relationship continues or thirty months, whichever occurs first unless prohibited by legislation. For purposes of this provision, it is understood and agreed that any absence under Article 14.01 shall be considered a leave with pay.
(g) It is understood that an employee who chooses to continue benefits under (a), (b) or (f) above shall provide the Employer with payment for the amount required on or before the first day of the month in which payment is due....
Effect of Absence. Whenever they are used in the Collective Agreement, the terms seniority and service shall be deemed to refer to length of employment subject to the following conditions:
(a) It is understood that during an approved absence not paid by the Employer not exceeding thirty (30) continuous days or any approved absence paid by the Home, both seniority and service will accrue.
(b) During an absence not paid by the Employer exceeding thirty (30) continuous calendar days, credit for service for purposes of salary increment, vacation, sick leave, or any other benefits under any provisions of the Collective Agreement or elsewhere, shall be suspended; the benefits concerned appropriately reduced on a pro-rata basis and the employee's anniversary date adjusted accordingly. In addition, the employee will become responsible for full payment of subsidized employee benefits in which he/she is participating for the period of the absence.
(c) It is further understood that during such leave of absence not paid by the Employer, credit for seniority for purposes of promotion, demotion, transfer or lay-off shall be suspended and not accrue during the period of absence. Notwithstanding this provision seniority shall accrue for a period of thirty-six (36) months if an employee's absence is due to a disability resulting in WSIB benefits, illness or other disability.
Effect of Absence. 16.01 It is understood that during an approved unpaid absence not exceeding thirty (30) continuous calendar days or any approved absence paid by the Employer, both seniority and service will accrue.
16.02 During an unpaid absence exceeding thirty (30) continuous calendar days, credit for service for purposes of vacation, salary increment, sick leave or any other benefits under any provisions of this Agreement or elsewhere shall be suspended, the benefits concerned appropriately reduced on a pro rata basis, and the employee’s anniversary date adjusted accordingly. In addition, the employee will become responsible for full payment of subsidized employee benefits in which she is participating for the period of the absence, except that:
a. Service will accrue and the Employer will continue to pay its share of the premiums when an employee is on pregnancy or parental leave, unless the employee gives the Employer written notice that she does not intend to pay her share of the premiums;
b. Service will accrue and the Employer will continue to pay its share of the premiums for up to one year if an employee’s absence is due to a disability resulting in WSIB benefits, unless the employee gives the Employer written notice that she does not intend to pay her share of the premiums;
c. An employee on authorized leave of absence due to illness or accident shall continue to be eligible for the Welfare Plan for up to twelve (12) months with the Employer continuing to pay its share of the premiums, unless the employee gives the Employer written notice that she does not intend to pay her share of the premiums.
16.03 It is further understood and agreed that, during such unpaid absence, credit for seniority for purposes of promotion, demotion, transfer or layoff shall be suspended after thirty (30) continuous calendar days and not further accrue during the period of absence.
16.04 Notwithstanding this provision, seniority shall accrue during pregnancy and parental leave, and for a period of one (1) year if an employee’s absence is due to a disability resulting in WSIB benefits. Notwithstanding this provision, seniority shall accrue during disability as per the Human Rights Code. For part-time employees, seniority will be calculated in the same manner as is calculated for maternity/paternity and parental leave.

(a) It is understood that during an approved unpaid absence not exceeding thirty (30) continuous days or any approved absence paid by the Hospital, both seniority and service will accrue.
(b) During an unpaid absence exceeding thirty (30) continuous calendar days, credit for service for purposes of salary increment, vacation, sick leave, or any other benefits under any provisions of the Collective Agreement or elsewhere, shall be suspended for the period of the absence in excess of thirty (30) continuous calendar days, the benefits concerned appropriately reduced on a pro rata basis and the employee's anniversary date adjusted accordingly. In addition, the employee will become responsible for full payment of any subsidized employee benefits in which he/she is participating for the period of absence, except that the Hospital will continue to pay its share of the premiums up to thirty (30) months while an employee is in receipt of WSIB benefits*. Such payment shall also continue while an employee is on sick leave (including the Employment Insurance Period) to a maximum of thirty (30) months from the time the absence commenced. Notwithstanding this provision, service shall accrue for a period of fifteen

In addition, the employee will become responsible for full payment of subsidized employee benefits in which he/she is participating for the period of the absence;
(c) It is further understood that during such leave of absence not paid by the Employer, credit for seniority for purposes of promotion, demotion, transfer or layoff shall be suspended and not accrue during the period of absence. Notwithstanding this provision, seniority shall accrue for a period of thirty- six (36) months if an employee’s absence is due to a disability resulting in W.S.I.B. benefits.
Effect of Absence. Effective June 4, 1996, part-time employees shall accrue seniority for a period of eighteen (18) months and service for a period of fifteen (15) weeks if absent due to a disability resulting in WSIB benefits, on the basis of what the employee’s normal regular hours of work would have been.”
