Common use of Community Fund Clause in Contracts

Community Fund. To further augment its commitment to the environment and the community in which Indian Point operates, Entergy shall establish a fund in the amount of $15 million (the “Fund”), the goal of which is to fund projects designed to benefit the Xxxxxx River and to support the community, and to provide environmental protection and other public benefits to the community. The Fund will provide for the completion of projects to be selected by NYS and Entergy, after consultation with regional environmental organizations and community groups and interests. With respect to the environmental projects, priority will be given to projects for dam or culvert removal, purchase of sensitive wetlands areas along the Xxxxxx River, continuation of scientific studies designed to advance the protection of riverine species, and prevention of the introduction of invasive species into the Xxxxxx River watershed, and other projects determined by NYS and Entergy that are consistent with the purposes for which the Fund has been established. (Entergy) filed with the New York State Department of State (NYSDOS), pursuant to the Coastal Zone Management Act, a certification stating that renewal of U.S. Nuclear Regulatory Commission (NRC) Facility Operating Licenses DPR-26 and DPR-64 for Indian Point Nuclear Generating Unit Nos. 2 & 3 (IP2 and IP3) for an additional 20 years was consistent with the New York State Coastal Management Program. NYSDOS objected to Entergy’s consistency certification on November 6, 2015. Pursuant to an agreement between Entergy and NYSDOS, among other parties, dated January 9, 2017, regarding the planned cessation of operation of IP2 and IP3, NYSDOS hereby withdraws its challenge to Entergy’s November 5, 2014 withdrawal of its consistency certification, and will proceed as if the withdrawal became effective on November 5, 2014, thereby (1) rendering NYSDOS’s November 6, 2015 objection moot and of no effect and (2) requiring Entergy to submit a new certification. Pursuant to that same agreement, Entergy will submit to NYSDOS a new consistency certification for renewal of the IP2 and IP3 operating licenses on or before January 31, 2017. The U.S. Department of Commerce and the NRC are being notified of this action by copy of this letter.
