Compliance with House Xxxx 06-1343 and House Xxxx 07-1073 a. In compliance with House Xxxx 06-1343 and House Xxxx 07-1073 amending Title 8 of the Colorado Revised Statutes by the addition of Article 17.5, Illegal Aliens-Public Contract for Services, enacted by the General Assembly of the State of Colorado, TRIAD shall not: 1. Knowingly employ or contract with an illegal alien to perform work under this contract or; 2. Enter into a contract with a subcontractor that fails to certify to TRIAD that the subcontractor shall not knowingly employ or contract with an illegal alien to perform work under this contract. b. In compliance with House Xxxx 06-1343 and House Xxxx 07-1073 enacted by the General Assembly of the State of Colorado: 1. TRIAD has confirmed or attempted to confirm the employment eligibility of all employees who are newly hired for employment in the United States through participation in the Basic Pilot Program [created in Public Law 208, 104th Congress, or its successor and expanded in Public Law 156, 108th Congress, or its successor, that is administered by the United States Department of Homeland Security] and, if Triad is not accepted into the Basic Pilot Program prior to entering into this contract, TRIAD shall apply to participate in the Basic Pilot Program every three months until TRIAD is accepted or this contract has been completed, whichever is earlier. This provision shall not be required or effective if the Basic Pilot Program is discontinued. 2. TRIAD shall be prohibited from using Basic Pilot Program procedures to undertake pre- employment screening of job applicants while this contract is being performed. 3. If TRIAD obtains actual knowledge that a subcontractor performing work under this contract knowingly employs or contracts with an illegal alien, TRIAD shall be required to: A. Notify the subcontractor and the County within three days that TRIAD has actual knowledge that the subcontractor is employing or contracting with an illegal alien; and B Terminate the subcontract with the subcontractor if within three days of receiving the notice required pursuant to subparagraph (a) of this paragraph (3) the subcontractor does not stop employing or contracting with the illegal aliens; except that TRIAD shall not terminate the contract with the subcontractor if during such three days the subcontractor provides information to establish that the subcontractor has not knowingly employed or contracted with an illegal alien. 4.   • Xxxxx-Xxxxx Act compliance IF proposing on PART 2, Texas Statute requires compliance with Xxxxx-Xxxxx Act, as amended (40 U.S.C. 3141- 3148). When required by Federal program legislation, all prime construction contracts in excess of $2,000 awarded by non-Federal entities must include a provision for compliance with the Xxxxx-Xxxxx Act (40 U.S.C. 3141-3144, and 3146-3148) as supplemented by Department of Labor regulations (29 CFR Part S, "Labor Standards Provisions Applicable to Contracts Covering Federally Financed and Assisted Construction"). In accordance with the statute, contractors must be required to pay wages to laborers and mechanics at a rate not less than the prevailing wages specified in a wage determination made by the Secretary of Labor. In addition, contractors must be required to pay wages not less than once a week. The non-Federal entity must place a copy of the current prevailing wage determination issued by the Department of Labor in each solicitation. The decision to award a contract or subcontract must be conditioned upon the acceptance of the wage determination. The non-Federal entity must report all suspected or reported violations to the Federal awarding agency. The contracts must also include a provision for compliance with the Xxxxxxxx "Anti-Kickback" Act {40 U.S.C. 314S), as supplemented by Department of Labor regulations (29 CFR Part 3, "Contractors and Subcontractors on Public Building or Public Work Financed in Whole or in Part by Loans or Grants from the United States").
