Compliance with Operative Agreements. The Borrower shall at all times (a) observe and perform all of the covenants, conditions and obligations required to be performed by it (whether in its capacity as the Lessor, the Owner Trustee or otherwise) under each Operative Agreement to which it is a party and (b) observe and perform, or cause to be observed and performed, all of the covenants, conditions and obligations of the Lessor under the Lease, even in the event that the Lease is terminated at stated expiration following a Lease Event of Default or otherwise.

Compliance with Operative Agreements. Lessor hereby covenants and agrees that it shall perform its obligations under the Operative Agreements including the Lease provided that Lessor shall have no liability whatsoever to Lessee for any failure to perform such obligations in circumstances where (i) Lessee shall have failed to perform any corresponding obligations under the Lease or (ii) such failure shall result, whether directly or indirectly, from a failure by Lessee to perform any express and specific obligations under the Lease or from the occurrence of a Default or an Event of Default.
