Compliance With Restrictions, Etc. Tenant, at its expense, shall comply with all restrictive covenants and other title exceptions affecting the Leased Property as of the date of this Lease and comply with and perform all of the obligations set forth in the same to the extent that the same are applicable to the Leased Property or to the extent that the same would, if not complied with or perform, impair or prevent the continued use, occupancy and operation of the Leased Property for the purposes set forth in this Agreement. Further, in addition to Tenant's payment obligations under this Agreement, Tenant shall pay all sums charged, levied or assessed under any restrictive covenants, declaration, reciprocal easement agreement or other title exceptions, equipment leases, leases and all other agreements affecting the Leased Property as of the date of this Lease promptly as the same become due and shall promptly furnish Landlord evidence of payment thereof.

Compliance With Restrictions, Etc. Tenant, at its expense, shall comply with all restrictive covenants or other title exceptions affecting the Premises and comply with and perform all of the obligations set forth therein to the extent that the same are applicable to the Premises or to the extent that the same, if not complied with or performed, would impair or prevent the continued use, occupancy and operation of the Premises. Further, in addition to Tenant’s payment obligations under this Lease, Tenant shall pay all reasonable, legal sums charged, levied or assessed under any restrictive covenants, declaration, reciprocal easement agreement or other title exceptions affecting the Premises promptly as the same become due and shall furnish Landlord evidence of payment thereof and indemnify, defend and hold harmless Landlord for any claim against Landlord for any such matters.
Compliance With Restrictions, Etc. Tenant, at its sole cost and expense, shall comply in all respects with all Permitted Encumbrances affecting the Leased Property and Tenant shall comply with and perform all of the obligations set forth under the same to the extent that the same are applicable to the Leased Property or to the extent that the same would, if not complied with or performed, impair or prevent the continued use, occupancy and operation of the Leased Property for the purposes set forth in this Lease; provided, however, the foregoing shall not require Tenant to perform any of Landlord’s obligations under any Permitted Encumbrance relating to a Facility Mortgage or any other financing incurred by Landlord. Further, in addition to Tenant’s payment obligations under this Lease, Tenant shall pay all sums charged, levied or assessed under any Permitted Encumbrances (other than any encumbrances relating to a Facility Mortgage or any other financing incurred by Landlord) promptly as the same become due and shall, upon receipt of written request by Landlord, promptly furnish Landlord evidence of payment thereof.

Further, in addition to Tenant’s payment obligations under this Lease, Tenant shall pay all sums charged, levied or assessed under any restrictive covenants, declaration, reciprocal easement agreement or other title exceptions, equipment leases, leases and all other agreements affecting the Leased Property whether as of the date of this Lease or hereafter, and promptly as the same become due and shall promptly furnish Landlord evidence of payment thereof, unless contested in good faith by Tenant and, in such case, Tenant shall provide to Landlord a bond or other security as reasonably required by Landlord in its sole discretion to cover any lien filed against the Leased Property or other liability affecting the Leased Property related to the contest of any sums charged, levied or assessed under any restrictive covenants, declaration, reciprocal easement agreement or other title exceptions, equipment leases, leases and all other agreements affecting the Leased Property.
Compliance With Restrictions, Etc. Subject to Tenant's right to contest in accordance with Section 8.3 of this Agreement, Tenant, at its expense, shall comply with all restrictive covenants and other title exceptions affecting the Leased Property and shall comply with and perform all of the obligations set forth in the same to the extent that the same are applicable to the Leased Property or to the extent that the same would, if not complied with or performed, impair or prevent the continued use, occupancy and operation of the Leased Property for the purposes set forth in this Agreement. Further, in addition to Tenant's payment obligations under this Agreement, Tenant shall, subject to Section 8.1 hereof, pay all sums charged, levied or assessed under any restrictive covenant, declaration, reciprocal easement agreement or other title exceptions, equipment leases, leases and all other agreements affecting the Leased Property promptly as the same become due and shall, upon Landlord's written request, promptly furnish Landlord evidence of payment thereof, provided any such charges, levies or assessments may, at the option of Tenant, be paid in installments (whether or not interest shall accrue on the unpaid balance of any such assessment), and Tenant may exercise the option to have the same paid in installments over the maximum amount of time permitted for installment payments thereof. With respect to any personal property which is leased by Tenant (other than Tenant's Personal Property), Tenant acknowledges and agrees that all such leases must be approved by Landlord in advance and if entered into prior to the Commencement Date hereof, must be approved by Landlord and expressly assumed by Tenant. In addition, all such leases shall by their terms be expressly subordinate to this Lease, shall not have a term which extends beyond the Term hereof, and shall expressly provide that the Landlord shall have the option, upon the expiration or earlier termination of this Lease, to assume any such lease or to terminate the same or require the owner of such leased personal property to immediately remove the same from the Leased Property.

Further, in addition to Tenant’s payment obligations under this Lease, Tenant shall pay (i) all sums charged, levied or assessed under any restrictive covenants, declaration, reciprocal easement agreement or other title exceptions affecting the Premises promptly as the same become due and shall furnish Landlord evidence of payment thereof, and (ii) any fees, charges, fines, costs, assessments, taxes, demands, orders, directives, or other requirements by any governmental agency asserting jurisdiction, or under any Environmental Laws which arise from or relate to Tenant’s use of, or Tenant’s activities at, the Premises, including, but not limited to, Storage Tank System registration fees, any applicable fees, and any consultant or attorneys’ fees related to or arising under any Environmental Laws.

Compliance With Restrictions, Etc. Tenant, at its expense, shall comply with all restrictive covenants and other title exceptions affecting the Leased Property as of the date of this Lease and comply with and perform all of the obligations set forth in the same to the extent that (i) the same are applicable to the Leased Property, (ii) the same would, if not complied with or performed, impair or prevent the continued use, occupancy and operation of the Leased Property for the purposes set forth in this Agreement and (iii) Landlord has affirmative obligations in connection with the common areas or other property as set forth in that certain Somerby at University Park Declaration of Covenants, Conditions and Restrictions recorded in Book 9706, Page 2423, and amended in Book 9815, Page 8213, in the public records of Jefferson County, Alabama ("Declaration"). Further, in addition to Tenant's payment obligations under this Agreement, Tenant shall collect and/or pay all sums charged, levied or assessed or required to be charged, levied or assessed by Landlord under any restrictive covenants, declaration, reciprocal easement agreement or other title exceptions, equipment leases, leases and all other agreements affecting the Leased Property, including the Declaration, as of the date of this Lease promptly as the same become due and shall promptly furnish Landlord evidence of payment thereof.
