The Contractor shall also utilize green and sustainable remediation practices in all aspects of the task order and project execution, as applicable.

Environmental Protection Requirements. Tenant is responsible for constructing and maintaining Tenant’s facilities and conducting Tenant’s operations in a manner that employs all reasonable means to limit the potential for environmental contamination of the Land and adjoining lands. This Article is to be read in harmony with other Articles of this Lease. When the terms and conditions of this Article are more restrictive than other Articles that could be construed to encompass the same topic, this Article shall control. Further, this Article shall be broadly interpreted so as to protect the environmental integrity and condition of the Land and to require compliance with Legal Requirements as to the Land under all circumstances.

Environmental Protection Requirements. The Contractor shall identify applicable Federal, State and Local laws, regulations, and Project specific orders or agreements and perform all work in accordance with said authorities. The Contractor shall ensure that all activities performed by its personnel, subcontractors and suppliers are executed in accordance with said authorities. Any incident of noncompliance noted by the Contractor shall immediately be brought to the attention of the USACE’s KO, COR, and PM via telephone, followed by written notice. Nothing in this PWS shall relieve the Contractor of its responsibility to comply with applicable laws and regulations. The Contractor shall investigate the requirements for and obtain all permits, licenses, approvals, and/or certificates necessary to accomplish the work specified. Also, provide environmental protective measures required to correct conditions, such as oil spills or debris that occur during the dredging operations. Comply with Federal, State, and PCCA Specification Section 01 35 21, “Pollution Prevention”, pertaining to water, air, and noise pollution. The dredging conditions specified and indicated describe conditions which are known. However, the Contractor is responsible for other conditions encountered which are not unusual when compared to the conditions recognized in the dredging business as usual in dredging activities such as those required under this contract.
