Concessionaire Responsibility for Capital Improvements. The Concessionaire shall be responsible for all capital improvements with respect to the System required to be completed during the Term in accordance with the terms of this Agreement, including as required by the Operating Standards and by changes in Law, which capital improvements include the Required Capital Improvements. The Concessionaire may undertake at its sole cost and expense and subject to the Approval of the City, the expansion of the System for the provision of Utility Services.
Concessionaire Responsibility for Capital Improvements. Other than the Ongoing Utility System Projects, the Concessionaire shall be responsible for all Capital Improvements with respect to the Utility System, including as required by the Performance Standards.

  • University Responsibilities (1) The University will use its best efforts to see that students selected for participation in the ALE are prepared for effective participation in the training phase of their overall education. The University will retain ultimate responsibility for the education of its students.

  • CONTRACTOR RESPONSIBILITY FOR SYSTEM AGENCY’S TERMINATION COSTS If the System Agency terminates the Contract for cause, the Contractor shall be responsible to the System Agency for all costs incurred by the System Agency and the State of Texas to replace the Contractor. These costs include, but are not limited to, the costs of procuring a substitute vendor and the cost of any claim or litigation attributable to Contractor’s failure to perform any Work in accordance with the terms of the Contract.
