Conditions to Start of Initial Improvements. As set forth in Section 3.1, this Agreement is first a lease disposition and development agreement. Accordingly, from and after the Effective Date, Tenant agrees to use good faith efforts to cause the following conditions to be satisfied as soon as reasonably possible, and these conditions must be satisfied by Tenant before it may begin to construct the Initial Improvements:
