CONFIRMATION OF AGENCY. (1) The Parties agree that the Operator will act as the agent for and on behalf of the JV Parties with respect to each provision of this Agreement that states that the Operator is assuming a right or obligation, or otherwise acting as agent, for and on behalf of the JV Parties. In such role as agent, the Operator will have no liability as principal except to the extent that the Operator represents its own interests in its respective capacity as a JV Party. (2) Any act or omission of the Operator in its capacity as agent for and on behalf of the JV Parties is, for the purposes of this Agreement, deemed to be an act or omission of each JV Party that the Operator was acting as agent for and on behalf of at the relevant time. (3) Any notice delivered to the Operator is, for the purposes of this Agreement, deemed to be notice to each of the JV Parties. (4) Any and all actions or omissions by the Operator in its capacity as agent for and on behalf of each of the JV Parties are legally binding on each of the JV Parties and each of the JV Parties waive any and all defenses that may be available to contest, negate or disaffirm the actions of the Operator as agent under this Agreement. (5) The Province will be entitled to rely on all statements, actions, omissions, representations and decisions of the Operator in its capacity as agent for and on behalf of the JV Parties as being the binding acts or omissions of all of the JV Parties or any of them, as applicable.

CONFIRMATION OF AGENCY. Pursuant to the existing Client Agreement between the Owner and T2R Properties Inc. (o/a T2 Condo Rentals) (the “Agent”), the Owner hereby appoints the Agent to be the Owner’s exclusive agent and representative with respect to the Property for the purposes of: a. setting rental terms in accordance with the Agent’s reasonable business judgement, prevailing market conditions, and any applicable laws; b. uploading listing materials to real estate or other marketing platforms, including Multiple Listing Services (“MLS”); c. setting tenant application processes and reviewing prospective tenant applications; and d. preparing and executing lease agreements with tenants, and commission agreements with any third-party realtors (if applicable).

  • Confirmation of Agreement Except as amended hereby, the Custody Agreement is in full force and effect and as so amended is hereby ratified, approved and confirmed by the Customer and the Bank in all respects.

  • Administration of Agreement All approvals referenced in this Agreement must be obtained from the parties' contract administrators or their designees. All notices must be given to the parties' contract administrators respectively. The OAG's contract administrator is Xxxxxxxxx X. Xxxxxx, Chief, Bureau of Advocacy and Grants Management. The Provider’s contract administrator will be provided at the time of execution. The parties will provide each other with written notification of any change in its designated representative for this Agreement. Such changes do not require a formal written amendment to this Agreement.

  • Ratification of Agreements The Original Agreement as hereby amended is hereby ratified and confirmed in all respects. The Loan Documents, as they may be amended or affected by this Amendment, are hereby ratified and confirmed in all respects. Any reference to the Credit Agreement in any Loan Document shall be deemed to be a reference to the Original Agreement as hereby amended. The execution, delivery and effectiveness of this Amendment shall not, except as expressly provided herein, operate as a waiver of any right, power or remedy of the Lenders under the Credit Agreement, the Notes, or any other Loan Document nor constitute a waiver of any provision of the Credit Agreement, the Notes or any other Loan Document.
