Conformity Assessment. 1. The Parties recognize that a broad range of mechanisms exists to facilitate the acceptance of conformity assessment results, including: (a) the importing Party's reliance on a supplier's declaration of conformity; (b) voluntary arrangements between conformity assessment bodies from each Party's territory; (c) agreements on mutual acceptance of the results of conformity assessment procedures with respect to specified regulations conducted by bodies located in the territory of the other Party; (d) accreditation procedures for qualifying conformity assessment bodies; (e) government designation of conformity assessment bodies; and (f) recognition by one Party of the results of conformity assessments performed in the other Party's territory. The Parties shall intensify their exchange of information on the range of mechanisms to facilitate the acceptance of conformity assessment results. 2. Where a Party does not accept the results of a conformity assessment procedure performed in the territory of the other Party, it shall, on request of the other Party, explain its reasons. 3. Each Party shall accredit, approve, license, or otherwise recognize conformity assessment bodies in the territory of the other Party on terms no less favorable than those it accords to conformity assessment bodies in its territory. If a Party accredits, approves, licenses, or otherwise recognizes a body assessing conformity with a particular technical regulation or standard in its territory and it refuses to accredit, approve, license, or otherwise recognize a body assessing conformity with that technical regulation or standard in the territory of the other Party, it shall, on request, explain the reasons for its refusal. 4. Where a Party declines a request from the other Party to engage in or conclude negotiations to reach agreement on facilitating recognition in its territory of the results of conformity assessment procedures conducted by bodies in the territory of the other Party, it shall, on request, explain its reasons.

23. Where In the event that a Party does not accept the results of a conformity assessment procedure performed carried out in the territory of the other Party, it the latter shall, on upon request of the that other Party, explain the reasons for its reasonsdecision.
34. Each Party shall accredit, approve, license, or otherwise recognize conformity assessment bodies in the territory of the other Party on terms no less favorable than those it accords accorded to conformity assessment bodies in its territory. If a Party accredits, approves, licensesauthorizes, or otherwise recognizes a body assessing conformity with to a particular specific standard or technical regulation or standard in its territory and it refuses to accredit, approve, licenseauthorize, or otherwise recognize a body assessing conformity with to that same standard or technical regulation or standard in the territory of the other Party, it the other Party shall, on requestrequest of that other Party, explain the reasons for its refusaldecision.
45. Where a Party declines a request from The Parties may enter into negotiations aimed at the other Party to engage in or conclude negotiations to reach agreement conclusion of agreements on facilitating mutual recognition in its territory of the results of their respective conformity assessment procedures conducted by bodies in procedures, following the territory principles of the other PartyTBT Agreement. In the event that a Party does not agree to enter into such negotiations, it shall, on requestat the request of that other Party, explain the reasons for its reasonsdecision.

If a Party accredits, approves, licenses, or otherwise recognizes a body assessing conformity with a particular technical regulation or standard in its territory and it refuses to accredit, approve, license, or otherwise recognize a body assessing conformity with that technical regulation or standard in the territory of the other Party, it shall, on request, explain the reasons for its refusal.
4. Where a Party declines rejects a request from by the other Party to engage in enter into or conclude negotiations to reach a mutual recognition agreement on facilitating recognition to facilitate the acceptance in its territory of the results of conformity assessment procedures conducted carried out by bodies in the territory of the other Party, it shallshall give reasons for its decision.
5. The Parties shall encourage that the activities developed within the framework of technical cooperation and assistance serve as a reference in a process of recognition of conformity assessment.
6. Each Party shall accredit, on requestapprove or, explain in accordance with its reasonsnational legislation, recognize conformity assessment bodies in the territory of the other Party, under terms no less favorable than those granted to conformity assessment bodies in its territory.
7. If a Party refuses to accredit, approve or, in accordance with its national legislation, recognize a conformity assessment body in the territory of the other Party, it shall give reasons for its decision.
