Committee on Sanitary and Phytosanitary Measures. 1. The Parties hereby establish a Committee on Sanitary and Phytosanitary Measures (“Committee”), comprising representatives of each Party, who are responsible for sanitary and phytosanitary issues in the fields of animal and plant health, food safety and trade. 2. The Committee shall be set up not later than 30 days after the entry into force of this Agreement. 3. The Committee shall carry out the functions necessary to implement the provisions of this Chapter, including, but not limited to: (a) coordinating the application of the provisions of this Chapter; (b) facilitating consultations on specific matters related to sanitary or phytosanitary measures; (c) establishing and determining the scope and mandate of the sub-committees; (d) promoting technical cooperation between the Parties, including cooperation in the development, adoption and enforcement of sanitary and phytosanitary measures; and (e) monitoring the compliance with the provisions of this Chapter. 4. The Committee shall establish, if the need arises and the Parties so agree, the following sub-committees: Sub-Committees on Animal Health, Plant Protection and Food Safety. The members of these sub-committees shall be designated by the relevant authorities in their respective fields. 5. The sub-committees shall carry out the following functions, including, but not limited to: (a) preparing terms of reference for their activities within the scope of their competence and informing results thereof to the Committee; (b) concluding specific agreements on matters of interest, involving higher technical- operating details, to be submitted to the Committee; and (c) establishing expeditious information exchange mechanisms to deal with consultations between the Parties. 6. The Committee shall meet once every two years, except as otherwise agreed. If an additional meeting is requested by a Party, it will be held in the territory of the other Party. The sub-committees shall meet, upon request of a Party. The meetings may also be held by telephone, video conference or other means, upon the agreement of both Parties. 7. The Committee shall report annually to the Commission on the implementation of this Chapter.

Committee on Sanitary and Phytosanitary Measures. 1. The Parties establish a Committee on Sanitary and Phytosanitary Measures consisting of sanitary and phytosanitary authorities and/or trade authorities of the Parties. 2. The Committee shall meet every 2 years or whenever it considers necessary. The Committee shall meet in presence or through teleconference, videoconference, or any other means; and shall be able to deal with sanitary and phytosanitary issues through telecommunications or correspondence. 3. At its first regular meeting, the Committee shall adopt its rules of procedure and if necessary, shall develop a Working Plan, which could be updated with the issues of interest proposed by the Parties. 4. The functions of this Committee include: (a) to monitor the implementation of this Chapter; (b) to review progress on addressing sanitary and phytosanitary matters that may arise between the Parties’ competent sanitary and phytosanitary authorities, including each Party’s priority market access interests; (c) to strengthen the communication on the Parties’ SPS-related administrative procedures to promote mutual understanding and compliance with the respective obligations under this Chapter; (d) to strengthen technical cooperation in sanitary and phytosanitary issues and seek the enhancement of any present or future relationship between the Parties; (e) to consult on issues, positions and agendas for meetings of the WTO/SPS Committee, Codex Alimentarius, the International Plant Protection Convention, the World Organization for Animal Health, and other international and regional fora on food safety and human, animal and plant health; (f) to establish technical working groups if necessary. The technical working groups may consist of expert-level representatives of the Parties as agreed, which shall identify, address, and attempt to resolve technical and scientific issues arising from this Chapter; (g) to hold technical discussions on sanitary and phytosanitary matters;and (h) other functions mutually agreed by the Parties. 5. The Committee shall be coordinated by: (a) for China, the Department of International Cooperation of the General Administration of Quality Supervision, Inspection and Quarantine, or its successor; and (b) for Peru, the Vice Ministry of Foreign Trade of the Ministry of Foreign Trade and Tourism, or its successor.
Committee on Sanitary and Phytosanitary Measures. 1. The Parties hereby establish the Committee on Sanitary and Phytosanitary Measures (“the Committee”), as set out in Annex 8.12. 2. The Committee shall hear matters regarding this Chapter and, without prejudice to Article 17.05(2) (Committees), shall carry out the following functions: a) promoting the means necessary for the training and specialization of technical staff; b) promoting the active participation of the Parties in international bodies; and c) creating and updating a database of specialists qualified in the fields of food safety, plant and animal health, for the purpose of the provisions of Article 17.06 (Groups of Experts).

Committee on Sanitary and Phytosanitary Measures. 1. The Committee on Sanitary and Phytosanitary Measures established pursuant to Article 15.2.1 (Specialised Committees) may: (a) develop the necessary procedures or arrangements for the implementation of this Chapter; (b) monitor the progress of the implementation of this Chapter; (c) confirm the successful completion of the confidence-building activity referred to in Article 5.8.3; (d) develop procedures for the approval of establishments for products of animal origin and, where appropriate, of production site for products of plant origin; and (e) provide a forum for discussion of problems arising from the application of certain sanitary or phytosanitary measures with a view to reaching mutually acceptable alternatives. In this connection, the Committee shall be convened as a matter of urgency, at the request of a Party, so as to carry out consultations. 2. The Committee shall be comprised of representatives of the Parties and shall meet once a year on a mutually agreed date. The venue of meetings shall also be mutually agreed. The agenda shall be agreed before the meetings. The chairmanship shall alternate between the Parties.

Committee on Sanitary and Phytosanitary Measures. 1. For the purposes of the effective implementation and operation of this Chapter, the Parties hereby establish a Committee on Sanitary and Phytosanitary Measures, composed of government representatives of each Party responsible for sanitary and phytosanitary matters. 2. The SPS Committee shall serve as a forum: (a) to consider any matter related to this Chapter, including relating to its implementation; (b) to improve the Parties' understanding of sanitary or phytosanitary issues that relate to the implementation of the SPS Agreement or this Chapter; (c) to enhance mutual understanding of each Party's sanitary or phytosanitary measures or the regulatory processes that relate to those measures; (d) to enhance communication and cooperation among the Parties related to sanitary or phytosanitary matters; (e) to identify and discuss, at an early appropriate stage, proposed sanitary or phytosanitary measures or revisions to existing sanitary or phytosanitary measures that may have a significant effect on trade in North America including for the purposes of issue avoidance and facilitating greater alignment of sanitary or phytosanitary measures; and (f) for a Party to share information, as appropriate, on a sanitary or phytosanitary matter that has arisen between it and another Party or Parties. 3. The SPS Committee may serve as a forum: (a) if appropriate, to identify and develop technical assistance and cooperation projects between the Parties on sanitary and phytosanitary measures; (b) to consult on matters and positions for meetings of the WTO SPS Committee, and meetings held under the auspices of the Codex Alimentarius Commission, the World Organisation for Animal Health, the International Plant Protection Convention, and other international organizations as appropriate; (c) to identify, prioritize, manage, and resolve bilateral or trilateral issues; (d) to review progress on addressing specific trade concerns related to the application of a sanitary or phytosanitary measure, with a view to facilitating mutually acceptable solution; (e) to establish and, as appropriate, determine the scope and mandate of technical working groups in areas such as, animal health, plant health, food safety, or pesticides, taking into account existing mechanisms, to undertake work related to the implementation of this Chapter; (f) to provide guidance to technical working groups, as needed and appropriate, for the identification, prioritization, and management of sanitary or phy...

Committee on Sanitary and Phytosanitary Measures. 1. The Parties establish a Committee on Sanitary and Phytosanitary Measures, whose composition is established in Annex 8.11. 2. The Committee shall examine matters relating to this Chapter and, without detriment to Article 18.05(2) (Committees), it shall: (a) Promote the facilities needed for the training and specialization of technical staff; (b) promote cooperation and exchanges of technical staff, including cooperation in the development, application and observance of sanitary and phytosanitary measures; (c) promote active participation by the Parties in international organizations; and (d) establish a roster of qualified specialists in the fields of food safety, plant health and animal health for the purposes of Article 18.07 (Groups of Experts).

The Committee shall monitor the implementation of the provisions of this chapter, the expeditious achievement of its objectives and make specific recommendations on sanitary and phytosanitary issues. 2. The Committee shall: a) Establish modalities it considers appropriate for the coordination and resolve matters referred to it; b) To facilitate the agricultural trade between the parties; promoting the improvement of sanitary and phytosanitary conditions in the territories of the Parties; c) Promote activities identified by the parties in accordance with article 5-04, 505, 5-06 5-07 5-15; and d) Facilitate consultations on specific matters on sanitary and phytosanitary measures; e) Establish working groups on animal health, plant and animal health and food safety, and shall determine its mandates, objectives and action lines; and f) It shall meet once a year, except as otherwise agreed and report annually to the Commission on the implementation of this chapter.
