Conserved Water. Water made available for acquisition under this Agreement and the Related Agreements attributable to: (i) Temporary Land Fallowing or crop rotation, if an allowed use is for irrigation, or (ii) projects or programs that enable the use of less water to accomplish the same purpose or purposes of allowed use; provided, however, that such term does not include water attributable to: (a) the activities described in (i) or (ii) above not voluntarily undertaken; or (b) to the activities described in (i) above voluntarily undertaken in exchange for money payment or other valuable consideration received from a governmental source other than SDCWA, MWD or CVWD; and (c) the resulting volume of reduced water produced from (a) or (b) above cannot be used anywhere within the IID Service Area.
Conserved Water. The Optionee shall have the option, but not the obligation to acquire up to 5,000 acre-feet per year of conserved water as an Annual Quantity Right (the “Initial 5K AF”) (the “Conserved Water”). The exercise price for the acquisition of the Initial 5K AF and the timing of such payments are set forth on the Price Schedule. Upon the Optionee’s exercise of the Option to purchase 5,000 acre-feet of conserved water as an Annual Quantity, CADIZ will make available an additional 5,000 acre-feet of conserved water as a one-time supply free of charge to the Optionee. The parties will determine a reasonable schedule for delivery of this latter 5,000 acre-feet of conserved water. The Conserved Water shall be delivered to the Optionee in the CRA each year on a mutually agreed schedule which shall provide for delivery of such water so that it can be used in the Optionee’s service area over a reasonable period of time at flows and rates that are established with the regional wholesale water purveyor within the MWD service area.
Conserved Water. “Conserved Water” shall mean indigenous groundwater that is extracted from the Cadiz Property under reasonable and prudent groundwater management practices.
Conserved Water. Water, or the right to the use of water, that may be sold, leased, exchanged, or otherwise transferred under § 1011(b) of the California Water Code, as in effect on the Execution Date.
Conserved Water. The Parties agree that the implementation of the Water Conservation Program by the Permittee will result in 163.684 AF/yr of groundwater from the Aquifer that will be conserved by the Permittee (“Conserved Water”), and that the Permittee will not withdraw the Conserved Water from the Aquifer under the Permit for any reason during the term of this Contract.
Conserved Water. The Optionee shall have the option, but not the obligation to acquire up to 5,000 acre-feet per year of conserved water as an Annual Quantity Right (the “Initial 5K AF”). The exercise price for the acquisition of the Initial 5K AF and the timing of such payments are set forth on the Price Schedule. Further, the Optionee shall have the option, but not the obligation, to acquire up to an additional 10,000 acre-feet per year of conserved water at the exercise price set forth on the Price Schedule (the “Additional 10K AF”) (collectively, the water acquired pursuant to this Section 2.2(a) being the “Conserved Water”).

Related to Conserved Water

  • Generator Subject to the provisions of this Section 29.36, Tenant shall be entitled to install, operate and maintain a generator and any other equipment related thereto, including, without limitation, a fuel system, wiring and shaft space (“Generator”) next to the Building at Tenant’s sole cost and expense (without paying any additional fee or rental to Landlord for the use thereof). Prior to the installation of the Generator, Tenant shall inspect the proposed location to determine a suitable location for the Generator, and Tenant shall submit written plans and specifications relative to the type, size and proposed location (including any proposed screening) of the Generator to Landlord for its review and written approval. Tenant shall be solely responsible for the cost of acquisition, installation, operation, and maintenance of the Generator; and Tenant shall install, maintain and operate the Generator in accordance with all federal, state, and local laws, statutes, ordinances, rules and regulations, including without limitation, obtaining and maintaining any and all permits, approvals and licenses required to install and operate the Generator by any governmental authority having jurisdiction. Landlord and Tenant agree that, upon the expiration of earlier termination of the Lease Term, Tenant shall not be required to remove the Generator, any associated cabling, wiring and screening or other improvements. Tenant shall not be entitled to grant or assign to any third party (other than a permitted assignee of Tenant’s rights under the Lease or a permitted subtenant relative to the Premises (or a portion thereof)) the right to use the Generator without Landlord’s prior written consent (which consent may be granted or withheld in Landlord’s discretion). Upon reasonable advance notice to Tenant (and provided Landlord reasonably coordinates with Tenant and provides an alternate source of backup generator capacity during said transition), Landlord shall be entitled to cause the Generator to be moved to another location near the Building, at Landlord’s cost and expense. Tenant shall pay all personal property taxes on the Generator. Tenant shall also pay any increases in the real property taxes of the Building due to the installation of the Generator within thirty (30) days of receipt of notice from Landlord which includes proof of such increase in taxes. Tenant’s indemnity obligations under Section 5.4.1.5 of the Lease, relating to the use of Hazardous Materials, shall apply to the use and operation of the Generator. Finally, Tenant’s insurance obligations under Section 10.3 of the Lease shall apply to the Generator.

  • Irrigation An irrigation reduced pressure zone (hereinafter referred to as “RPZ”) is required for any irrigation systems and must be installed by the Developer and/or eventual lot owner and tested in accordance with the Minnesota Department of Health Guidelines for Designing Backflow Prevention Assembly Installations (hereinafter referred to as “Guidelines”). The initial test results and certification shall be submitted to the City of Maple Grove Public Works Department. Subsequently, the RPZ must be tested, per the Guidelines, at least annually by a certified tester with the results reported to the City of Maple Grove Building Department and the RPZ must be rebuilt as needed in accordance with the Guidelines. Test/rebuilt reports shall be mailed or faxed to the City of Maple Grove Building Department at (▇▇▇) ▇▇▇-▇▇▇▇. The irrigation system shall be designed and the Plans shall be modified accordingly, prior to the issuance of any permits for the development of the Property, to accommodate a 1-inch water meter and a maximum flow of 50 gallons per minute.

  • Generators Temporary installation of generators, and permanent installation of generators that are placed inside existing non-residential buildings or that occupy an area under 50 square feet behind the building they serve.
