CONSTRUCTION AND INSPECTIONS. The Purchaser agrees to meet a representative of the Vendor prior to the Occupancy Date (or the Title Closing Date if possession is being given thereon) to inspect the Property and to list all incomplete items and mutually agreed deficiencies with respect to the Property, on the form of Certificate of Completion and Possession provided for under the ONHWPA. The said Certificate shall be executed by both the Purchaser and a representative of the Vendor forthwith after such inspection and same shall constitute the Vendor’s only undertaking with respect to incomplete or deficient work, and such work shall be completed by the Vendor within a reasonable period of time after the Occupancy Date, having regards to weather conditions and the availability of equipment, supplies and labour. The Purchaser further acknowledges and agrees that no further request for the completion or correction of items may be maintained by the Purchaser, and this shall serve as a good and sufficient release of the Vendor in that regard. The Vendor shall arrange for the inspection with the Purchaser and the Purchaser shall be entitled to designate a representative in writing to attend such inspection in his or her place. The Purchaser hereby irrevocably constitutes and appoints the Vendor to be and act as his or her lawful attorney, in the Purchaser’s name, place and stead, in order to execute the Certificate of Completion and Possession if the Purchaser (or an appointed representative) fails to attend on the scheduled inspection date. The Purchaser hereby confirms and agrees that this power of attorney may be exercised by the Vendor during any subsequent legal incapacity of the Purchaser.

CONSTRUCTION AND INSPECTIONS. The Water Department currently inspects construction sites for compliance with the Post Construction Stormwater Management Plan and Erosion and Sedimentation Control Plan. Any sub-surface SMP requires a Water Department inspector to be present during the installation.

  • Tests and Inspections 5.2.1 Tests and Inspections shall comply with title 24, part 1, California Code of Regulations, group 1, article 5, section 4-335, and with the provisions of the Specifications.

  • Audits and Inspections At any time during normal business hours and as often as the CITY may deem necessary, there shall be made available to the CITY for examination all of CONTRACTOR’S records with respect to all matters covered by this Agreement. CONTRACTOR shall permit the CITY to audit, examine, and make excerpts or transcripts from such records, and to make audits of all contracts, invoices, materials, payrolls, records of personnel, conditions of employment and other data relating to all matters covered by this Agreement.

City shall have the right to access and examine such records, without charge, during normal business hours. City shall further have the right to audit such records, to make transcripts therefrom and to inspect all program data, documents, proceedings, and activities.

  • Monitoring and Inspection The Interconnected Transmission Owner may monitor construction and installation of Interconnection Facilities that the Interconnection Customer is constructing. Upon reasonable notice, authorized personnel of the Interconnected Transmission Owner may inspect any or all of such Interconnection Facilities to assess their conformity with Applicable Standards.

  • Maintenance and Inspection of Records The City, or its authorized auditors or representatives, shall have access to and the right to audit and reproduce any of the Contractor's records to the extent the City deems necessary to insure it is receiving all money to which it is entitled under the Contract and/or is paying only the amounts to which Contractor is properly entitled under the Contract or for other purposes relating to the Contract. The Contractor shall maintain and preserve all such records for a period of at least three (3) years after termination of the Contract. The Contractor shall maintain all such records in the City of Xxxxxx. If not, the Contractor shall, upon request, promptly deliver the records to the City of Xxxxxx or reimburse the City for all reasonable and extra costs incurred in conducting the audit at a location other than the City of Xxxxxx, including, but not limited to, such additional (out of the City) expenses for personnel, salaries, private auditors, travel, lodging, meals, and overhead.

  • Entry and Inspection Lessee shall permit Lessor or Lessor's agents to enter upon the premises at reasonable times and upon reasonable notice, for the purpose of inspecting the same, and will permit Lessor at any time within sixty (60) days prior to the expiration of this lease, to place upon the premises any usual "To Let" or "For Lease" signs, and permit persons desiring to lease the same to inspect the premises thereafter.
