Common use of Construction Change Directive Clause in Contracts

Construction Change Directive. To the extent that CCPRC desires to make changes pursuant to Article 3.1 or 3.2, above, and the parties are unable to execute a written change order as a consequence of disagreements as to the cost adjustment or scheduling impact of such changes, CCPRC may unilaterally direct the Contractor, in writing, to perform work through a written construction change directive. Contractor shall promptly perform such work in accordance with the change directive. In such instance CCPRC shall pay the Contractor any undisputed sums upon completion of the work. In such cases, Contractor may assert claim for additional payment pursuant to Article 11, hereunder.
