Common use of Construction Schedule Clause in Contracts

Construction Schedule. 3.5.1 The Contractor shall: .1 prepare and submit to the Owner and the Contract Administrator within seven (7) Calendar Days from the Commencement Date, unless otherwise stipulated elsewhere in the Agreement or agreed to by the Contract Administrator, a construction schedule for their review and acceptance that indicates the timing of the major activities of the Work and provides sufficient detail of the critical events and their inter-relationship to demonstrate the Work shall be performed in conformity with the Contract Time. The construction schedule shall: (1) take into account the phasing and sequencing of construction and the completion dates contained in the Agreement or as otherwise required by the Contract Administrator or the Owner; (2) include and conform to the Key Work Milestones or any other milestones for the performance of the Work set out in the Agreement; (3) be of a computerised type and provided in both electronic format and hard copy; (4) show the Project critical path and the critical path must be identified in a contrasting colour (red) from the other activities; (5) clearly show, in weekly intervals, the logic and timing of major activities, proposed start dates and estimated duration for activities; and (6) have a level of detail sufficient to identify the Contractor and each specific Subcontractor and their respective parts of the Work and the specific location thereof. Once approved by the Owner and the Contract Administrator, the construction schedule submitted by the Contractor under this GC 3.5.1.1, as updated by the Contractor and approved by the Owner and Contract Administrator, shall become the “Construction Schedule”. The Construction Schedule (and any approved updates) shall be the benchmark against which the progress of the Work is to be measured for the purposes of the Agreement; .3 maintain a Current Schedule and update the Current Schedule every two (2) weeks, unless otherwise stipulated elsewhere in the Agreement or agreed to by the Contract Administrator, and provide the updated Current Schedule to the Owner and Contract Administrator. For clarity, the Current Schedule shall be used for information purposes only; .4 advise the Contract Administrator of any revisions required to the Construction Schedule as the result of extensions of the Contract Time as provided in 7.CHANGES IN THE WORK and provide the Owner and Contract Administrator for approval, an updated Construction Schedule reflecting such extensions; and .5 perform the Work in accordance with the Construction Schedule including the Key Work Milestones. 3.5.2 If the Contractor fails to submit the initial or any updated Construction Schedule satisfactory to the Contract Administrator, the Owner shall be entitled to withhold or delay payments under the Agreement until the Contractor complies with the requirements of GC 3.5.1.

Construction Schedule. 3.5.1 The A. Upon approval by HISD, the completion date in the required schedule shall become the “Completion Date” for the particular Job Order, and shall be the date that all Work under the Job Order is to be complete. B. The Contractor shall submit a progress report weekly, or as otherwise directed by the HISD Project Manager, and shall deliver three (3) copies of GC 3.5.1the annotated schedule to the HISD Project Manager. If, in the opinion of the HISD Project Manager, the Contractor falls behind the approved schedule, the Contractor shall take steps necessary to improve its progress, including those that may be required by the HISD Project Manager, without additional cost to HISD. In this circumstance, the HISD Project Manager may require the Contractor to increase the number of shifts, overtime operations, days of Work, and/or the amount of construction plant, and to submit for approval any supplementary schedule or schedules in chart form as the HISD Project Manager deems necessary to demonstrate how the approved rate of progress will be regained.

The Construction Schedule (and any approved updates) shall be the benchmark against which the progress of the Work is to be measured for the purposes of the Agreement; .3 monitor the progress of the Work relative to the Construction Schedule; maintain a Current Schedule and update the Current Schedule every two (2) weeks, unless otherwise stipulated elsewhere in the Agreement or agreed to by the Contract Administrator, and provide the updated Current Schedule to the Owner and Contract Administrator. For clarity, the Current Schedule shall be used for information purposes only; .4 advise the Contract Administrator of any revisions required to the Construction Schedule as the result of extensions of the Contract Time as provided in 7.CHANGES 7..CHANGES IN THE WORK and provide the Owner and Contract Administrator for approval, an updated Construction Schedule reflecting such extensions; and .5 perform the Work in accordance with the Construction Schedule including the Key Work Milestones. 3.5.2 If the Contractor fails to submit the initial or any updated Construction Schedule satisfactory to the Contract Administrator, the Owner shall be entitled to withhold or delay payments under the Agreement until the Contractor complies with the requirements of GC 3.5.1.

The construction schedule shall: (1i) take into account the phasing and sequencing of construction and the completion dates contained in the Agreement or as otherwise required by the Contract Administrator or the Ownerinclude a Design Documentation Schedule; (2ii) include and conform provide for a sequence for the Project which conforms with the requirements for access to the Key Work Milestones or any other milestones Project for the purpose of Occupant's Improvements as set out in the program for the performance of the Work set out such Occupant's Improvements provided to Westfield by Owner's Representative, which requirements shall be recorded as milestone dates in the AgreementConstruction Schedule; (3iii) be delineate the respective Stages (if any) of a computerised type and provided in both electronic format and hard copy; (4) show the Project critical path and the critical path must be identified in a contrasting colour (red) from the other activities; (5) clearly show, in weekly intervals, the logic and timing of major activities, proposed start dates and estimated duration for activitiesProject; and (6iv) have a level provide an estimated date for the achievement of detail sufficient Substantial Stage Completion of each Stage, Substantial Project Completion and Final Completion. (b) On and after the Commencement Date Westfield shall proceed with the Project in accordance with the Construction Schedule, as adjusted or amended from time to identify time under the Contractor relevant provisions of this Agreement and each specific Subcontractor by delays caused by Force Majeure Events. (c) Westfield shall update the Construction Schedule as and their respective parts when necessary to reflect any changes to the timing or sequence of the Work activities included therein or in the Design Documentation Schedule and shall forthwith submit the specific location thereof. Once approved by the Owner and the Contract Administrator, the construction schedule submitted by the Contractor under this GC 3.5.1.1, as updated by the Contractor and approved by the Owner and Contract Administrator, shall become the “Construction Schedule”. The revised Construction Schedule or Design Documentation Schedule to Owner's Representative for review and approval. (and any approved updatesd) shall be the benchmark against which the progress If a proposed updating of the Work is Construction Schedule or Design Documentation Schedule may affect the milestone dates provided in the Construction Schedule for access to be measured the Project for the purposes of Occupants' Improvements, Westfield shall forthwith notify Owner's Representative of the Agreement; .3 maintain a Current details of the proposed updating, and obtain instructions from Owner's Representative in relation thereto in connection with the submission of the updated Construction Schedule and update the Current Schedule every two (2) weeksor Design Documentation Schedule, PROVIDED that, unless otherwise stipulated elsewhere agreed in the Agreement or agreed to writing by the Contract AdministratorOwner's Representative, such notice to, and provide the updated Current Schedule instructions from, Owner's Representative shall not constitute an amendment to the Owner and Contract Administrator. (e) Owner's Representative may from time to time instruct a deviation from the Construction Schedule as or Design Documentation Schedule with respect to the result timing or sequence of extensions any activities. If the need for the deviation arose from a default or omission of Owner or its tenants, and Westfield is able to establish that in implementing the deviation it has incurred in good faith additional costs and expenses which it would not have otherwise incurred, Owner shall reimburse Westfield for such extra costs and expenses. (f) Westfield shall be responsible for the execution of the Contract Time as provided in 7.CHANGES IN THE WORK and provide the Owner and Contract Administrator for approval, an updated Construction Schedule reflecting such extensions; and .5 perform the Work Project in accordance with the Construction Schedule including and shall provide (either on its own account or through Contractors) all necessary labor, materials, machinery and equipment required for the Key Work Milestones. 3.5.2 If construction of the Contractor fails to submit the initial or any updated Construction Schedule satisfactory to the Contract Administrator, the Owner Project and shall be entitled to withhold or delay payments under solely responsible for the Agreement until the Contractor complies with the requirements proper coordination of GC 3.5.1all Contractors.
