CONTAINERS AND PALLETS. 16.1 This Clause 16 shall only apply where containers or pallets belonging to Brenntag are used in connection with the delivery of the Goods. 16.2 The value of all chargeable containers or pallets used in connection with the delivery of the Goods will be shown as a separate item on Brenntag's sales invoice for the Goods and shall be paid for in full by the Buyer when payment for the Goods is due. 16.3 All chargeable containers or pallets returned, at the Buyers expense to Brenntag, in good and complete condition, within three (3) months of receipt by the Buyer, may be eligible for a credit to be used against purchases of Goods within twelve (12) months of the date of award of such credit. If such credit is not used within that period, it shall lapse. Brenntag shall have no obligation to accept the return of containers or pallets that are in any way damaged. 16.4 If the Buyer elects to retain the containers or pallets it must remove all reference to Brenntag branding on them.

Brenntag shall have no obligation to accept the return of containers or pallets that are in any way damaged. 16.4 If the Buyer elects to retain the containers or pallets it must remove all reference to Brenntag branding on them. 16.5 If there is any change in applicable legislation or regulations regarding packaging and the same directly or indirectly results in additional costs being incurred by Brenntag in the performance of this agreement, Brenntag shall be entitled to increase the prices to the extent required to recover such same costs from the Buyer. 16.6

Any pallets or containers used for the delivery, storage or display of the Products are not included in the price of the Products and will remain property of their owner. 2. Buyer must promptly return or exchange the pallets and containers in its custody on the day of delivery, unless otherwise agreed between Parties, or reimburse BASF NZ the cost of replacement or repair of lost or damaged pallets and containers. 3. BASF NZ may charge a deposit to Buyer for a pallet or container which will be credited in full if the pallet or container is returned to BASF NZ within 3 months of dispatch and is in good order and condition.

CONTAINERS AND PALLETS. The Contractor shall collect without charge any returnable containers (including pallets) within twenty-one days of the date of the relevant delivery note, unless otherwise instructed by the Company. Empty containers not so removed may be returned by the Company at the Contractor's expense or otherwise disposed of at the Company's discretion. Charged containers shall be credited in full by the Contractor upon collection or return.

  • Containers The marine and intermodal cargo containers either owned or leased by the Borrower and employed by the Borrower in the conduct of its business, including, without limitation, refrigerated, dry van, tank, open top and flat rack containers and refrigeration units and generator sets associated therewith, but excluding any chassis for such containers.
