Common use of Contingency Planning Clause in Contracts

Contingency Planning. If any of the “Capacity Loss below 1000MW” or “Force Majeure” events set forth in Section 10.1 of the Restated Agreement occur, the Authority will assess the overall severity of the event on the Customer and shall take the following actions: (a) promptly notify the Customer of such event and convene a meeting of affected Customers to discuss the Authority’s response to such event; and (b) if requested by the Customer, make a good faith effort to mitigate any adverse impact of such event on the Customer.
