Continuing Control. To satisfy the continuing control requirements of the FTA as set forth in 49 U.S.C. § 5307(c)(1)(B), the Parties agree that upon completion of construction, the City will allow the Project as a permitted use within City right of way for the life of the Project for the benefit of the public. The City retains the ownership of the right-of-way and control of utility easements, property leases, private crossing agreements, and utility franchise rights.

Continuing Control. TriMet cannot construct or implement the Project without the use of City right-of-way or property. The City will allow TriMet to use City right-of-way and property for the Project without being compensated for such use. To satisfy the continuing control requirements of the FTA as set forth in 49 U.S.C. § 5307(c)(1)(B), the Parties agree that upon completion of construction, ownership and maintenance of most right of way and roadway improvement required for the Project, including travel lanes, sidewalks, traffic and pedestrian signals, and stormwater improvements, will be transferred to the City. TriMet will own and maintain light rail infrastructure, including tracks, stations, shelters, benches, fare collection equipment, and signage. The City will allow the Project as a permitted use within City right of way for the life of the Project, and TriMet will operate and maintain the Project in accordance with applicable federal law.

  • Continuing as Plan Sponsor Nothing in this Disaffiliation Agreement shall prevent Local Church, after the Disaffiliation Date, from continuing to sponsor benefit plans from the General Board of Pension and Health Benefits, to the extent permitted by federal law, and provided that Local Church has not expressly resolved that it no longer shares common religious bonds with The United Methodist Church.
