Continuing Liability Insurance Coverage. The Group shall obtain or require each of its Physician Employees and Physician Extender Employees to obtain continuing liability insurance coverage under either a "tail policy" or a "prior acts policy," with the same limits and deductibles as the insurance coverage provided pursuant to Section 9.1 upon the termination of such physician's relationship with the Group for any reason, unless such physician was covered with an occurrence-based policy while employed or retained by the Group. In the event that the Group, any Physician Employee or Physician Extender Employees fails to obtain such continuing liability insurance coverage, Administrator may do so. The cost of such continuing liability insurance coverage shall be included in Practice Expenses unless such cost is borne by the Physician Employee.

Continuing Liability Insurance Coverage. The Orthodontic Entity and Orthodontist shall obtain or require each of Orthodontist and their Orthodontic Entity Professional Employees to obtain continuing liability insurance coverage under either a "tail policy" or a "prior acts policy," with the same limits and deductibles as the insurance coverage provided pursuant to SECTION 8.1 for each orthodontist associated with the Orthodontic Entity upon the termination of such orthodontist's relationship with the Orthodontic Entity for any reason. In the event that neither the Orthodontic Entity, Orthodontist nor the Orthodontic Entity Professional Employees obtains such continuing liability insurance coverage, Apple may do so. The costs of continuing liability insurance coverage shall be included in Orthodontic Entity and Orthodontist Expenses unless such cost is borne by Orthodontist or the Orthodontic Entity Professional Employee.
