In the event of a removal, the employee shall not be permitted returned without the prior approval of the OCCC. If an employee is noted as Do Not Return (DNR’d), that employee shall not return to utilize Day Labor or Temporary Workers to provide any services at any District facility. This includes any employees or agents that are hired prior to contract award. The Contractor shall instruct its personnel that no gratuities shall be solicited or accepted from tenants, customers or other persons at the OCCC. The Contractor shall be responsible for ensuring that all articles found by its employees or agents on the Center’s premises are turned over to the OCCC’s designated representative in charge of the Contractor are not permitted to play loud music, to make unnecessary noises, or to use vulgar or inappropriate language that causes offense to otherssuch articles.

This supervisor shall be fully trained and qualified in painting services, and shall be a non-working supervisor. Any costs incurred for this supervisor shall be borne by the Contractor, and shall not be a billable hourly charge. The Supervisor will be responsible for continuous supervision of all their employees. The Supervisor must have ten (10) years of experience in all fields that he/she will are specified in this Contract (including but not engage in limited to, painting, drywall installation, epoxy painting, etc). The supervisor must be able to maintain supervision between multiple projects at one time.
H. In the unlawful manufacture, sale distribution, dispensation, possession, or use event of a controlled substance special work assignment or drug during emergency services, the performance Contractor shall provide a twenty-four (24) hour point of contact for non-standard working hours. The on-site supervisor must have access to emails and phone calls from the contract designated OCCC designee throughout the day.
I. All painting personnel, shall identify themselves at the appropriate administrative office upon arrival on site and that a drug-free workplace will be prior to beginning work and upon completion of work and leaving site.
J. The OCCC shall not pay any overtime rate for any employee provided for by the Contractor. It is the Contractor’s responsibility to provide employees or agents during that can work up to a maximum of ten (10) hours without charging the performance OCCC for overtime.
K. The Contractor’s team shall be comprised, at a minimum, of ten (10) employees with the following:
1. Six (6) painters who are OSHA certified in lift operation, to include any lift from a nineteen (19) foot scissor lift up to a one-hundred thirty-five (135) foot boom lift.
2. Two (2) painters experienced in the correct operation of paint striping equipment.
3. Two (2) painters experienced in the use of airless spray painting equipment. Copies of relevant training and certification documents shall be made available to the County’s Representative upon request. Contractor’s employees shall carry copies of OSHA certifications on their person when using OCCC lifts.
L. The Contractor shall provide a final list of personnel by name and title that will perform the scope specified herein within five (5) of contract award. The Employee listing shall include the employee’s full name, tile, and number of years of experience. Only employees on the list shall be used to perform services under this contract. The Contractor also certifies that he will secure from any subcontractor who works on must maintain the minimum number of employees for the life of this contract, written certification and provide any notification of any changes to the same drug free workplace requirementslist, and an updated list shall be provided to the County within twenty-four (24) hours of any revisions.

The Contractor certifies that he/she will not engage in the unlawful manufacture, sale distribution, dispensation, possession, or use of a controlled substance or drug during the performance of the contract and that a drug-free workplace will be provided for the Contractor’s employees or agents during the performance of the contractrenewed yearly. The Contractor also certifies that he will secure from any subcontractor who works on the contractmust advise its affected Personnel that, written certification of the same drug free workplace requirements. Contractor Personnel. a. Contractor shall furnish, at Contractor's staff is expected to present a professional appearance. All personnel of ’s cost, the Personnel in the numbers, classifications and Work schedules as set forth in Appendix B.

c. Contractor will have roustabout crews available on the Rig to load and unload boats from the Rig and perform other labor on a twenty-four (24) hour basis, together with a catering crew sufficient to provide room and board for all persons on board the Rig.
d. At the request of Operator, Contractor shall furnish additional personnel as Operator may designate; Operator shall reimburse Contractor for the direct costs and expenses of such additional Personnel, including wages and salaries, and other employee benefits which apply to the category of Contractor’s Personnel. Contractor will seek approval of Operator prior to changing out key personnel which shall not be neatunreasonably withheld.
e. If, well groomedwith Operator’s consent, properly uniformed in industry standard uniforms and Contractor’s Personnel are expected to conduct themselves at all times in a responsible and courteous manner while performing reduced, Operator shall be credited with the savings thereby resulting.
f. For any work under this Agreement and/or whenever they are on District property. The following code of conduct will be adhered to by the Contractor, his agent(s) and/or his employees. If day that Contractor fails to ensure that its employees provide the numbers and classification of Personnel specified in Appendix B, the rate at which Contractor is being paid for such day shall be reduced by an amount equivalent to the amount of wages and employee benefits which would have otherwise have been paid for such personnel, subject to Contractor being allowed a reasonable period of time to replace Personnel, which shall not exceed twenty-four (24) hours (except in the case of Force Majeure or other agents comply with these requirementssevere weather which would prevent reasonable means of transportation). Provided, then however, no reduction shall apply for missing Personnel due to medical reasons or reasons of compassion.
g. Contractor agrees to make any and all payments of all Contractor’s Personnel’s income tax withholding, social security taxes, premiums, contributions, Workmen’s Compensation Insurance, and Unemployment Insurance, which may be terminated for cause under this Agreement:
A. All employees of the levied or assessed pursuant to Federal and State law, which are measured by wages, salaries, or other remuneration paid to Contractor Personnel; Contractor shall wear a recognizable uniform. No hats will withhold from wages and salaries of Contractor Personnel all sums required by law to be worn inside withheld; Contractor shall pay the building. All same promptly when due to the proper authorities and shall furnish Operator evidence of Contractor’s employees and agents performing work must carry a government-issued photo ID. Contractor’s employees and agents will present ID to District Staff such payments, upon request. This provision will be strictly enforcedrequest when required for audit purposes.
