Contractor’s Personnel. The Contractor shall employ only personnel who are appropriately qualified, skilled and experienced in their respective trades or occupations. The Authority may require the Contractor to remove any personnel engaged for the Works, who in the opinion of the Authority:
(a) has engaged in any misconduct;
(b) is incompetent or negligent in the performance of his duties;
(c) fails to conform with any provisions of the Contract;
(d) engages in any conduct which is prejudicial to safety, health, or the protection of the environment; or
(e) makes errors in the discharge of his functions. If appropriate and required by the Employer, the Contractor shall then appoint (or cause to be appointed) a suitable replacement person.
Contractor’s Personnel. Contractor warrants that all Contractor personnel engaged in the performance of Work under this Contract shall possess sufficient experience and/education to perform the services requested by the County. County expressly retains the right to have any of the Contractor personnel removed from performing services under this Contract. Contractor shall effectuate the removal of the specified Contractor personnel from providing any services to the County under this Contract within one business day of notification by County. County shall submit the request in writing to the Contractor’s Project Manager. The County is not required to provide any reason, rationale or additional factual information if it elects to request any specific Contractor personnel be removed from performing services under this Contract.
Contractor’s Personnel. (i) The Contractor shall ensure that the personnel engaged by it or by its Sub- contractors in the performance of its obligations under this Agreement are at all times appropriately and adequately qualified, skilled and experienced in their respective functions in conformity with Good Industry Practice. The Contractor will try to hire at least 10% (ten percent) trained workmen as per the National Skills Qualifications Framework. If necessary, the requisite workmen may be got trained by the Contractor at his cost through authorized training centres of the Directorate General of Training (DGT). The Contractor will organize training at project site/ sites for the trainees as and when required as per the training schedule finalized in consultation with the training centres. The trainees shall be paid stipend by the Contractor (subject to a maximum of Rs. 15,000/- per person) on the basis of minimum wages to compensate for loss of income during the training period.
(ii) The Authority’s Engineer may, for reasons to be specified in writing, direct the Contractor to remove any member of the Contractor’s or Sub-contractor’s personnel. Provided that any such direction issued by the Authority’s Engineer shall specify the reasons for the removal of such person.
(iii) The Contractor shall on receiving such a direction from the Authority’s Engineer order for the removal of such person or persons with immediate effect. It shall be the duty of the Contractor to ensure that such persons are evicted from the Site within 10 (ten) days of any such direction being issued in pursuance of Clause 4.4 (ii). The Contractor shall further ensure that such persons have no further connection with the Works or Maintenance under this Agreement. The Contractor shall then appoint (or cause to be appointed) a replacement.
Contractor’s Personnel. Contractor shall provide all personnel and Subcontractor personnel necessary to provide the Work authorized under this Agreement. Contractor and/or its Subcontractors shall provide certain Key Personnel, including Contractor’s Project Manager(s), to perform certain Work set forth in this Agreement and in Work Orders. Contractor’s Project Manager shall: Serve as the primary contact with the State’s Project Manager and personnel; Manage the day to day activities of Contractor and its Subcontractor’s personnel; Identify the appropriate resources needed; Plan and schedule the Work; Meet budget and schedule commitments; Provide Progress Reports in accordance with this Agreement; and Act to ensure the overall quality of the Work performed. The State reserves the right to disapprove the continuing assignment of any Key Personnel provided under this Agreement, if, in the State's opinion, the performance of Key Personnel is unsatisfactory. The State agrees to provide Notice to Contractor in the event it makes such a determination. If the State exercises this right, Contractor shall immediately assign replacement Key Personnel, possessing equivalent or greater experience and skills. If any of Key Personnel assigned to a Project, through no cause or fault of Contractor, become unavailable to perform Work, Contractor shall immediately provide replacement Key Personnel, possessing equivalent or greater experience and skills as required by this Agreement and as further specified in any resumes referenced in Work Orders. Contractor shall ensure that the same Key Personnel named in Work Orders are retained during the performance of the Work of that Work Order. However, Contractor may, with approval of the State’s Project Manager, introduce substitute Key Personnel with specific skill sets/qualifications, or release Key Personnel whose skill sets/qualifications are no longer needed, if advance approval in writing is received from the State’s Project Manager. If any of the Key Personnel identified as specified in an authorized Work Order terminate their employment during the period of performance of a Work Order, Contractor will provide a substitute acceptable to the State's Project Manager. If any Key Personnel become unavailable or are disapproved and Contractor cannot furnish a replacement acceptable to the State, the State may terminate this Agreement or the applicable Work Order for cause, pursuant to Exhibit A - Standard Provisions, article 3.
Contractor’s Personnel. Unless otherwise approved by CITY, CONTRACTOR shall use its own employees to perform the services described in this Contract. CITY has the right to review and approve any personnel who are assigned to work under this Contract. CONTRACTOR shall remove personnel from performing work under this Contract if requested to do so by CITY. CONTRACTOR shall not use Subcontractors to assist in performance of this Contract without the prior written approval of CITY. If CITY permits the use of Subcontractors, CONTRACTOR shall remain responsible for performing all aspects of this Contract and paying all Subcontractors. CITY has the right to approve CONTRACTOR’S Subcontractors, and CITY reserves the right to request replacement of any Subcontractor. CITY does not have any obligation to pay CONTRACTOR’S Subcontractors, and nothing herein creates any privity of contract between CITY and any Subcontractor.
Contractor’s Personnel. The Contractor warrants that all persons employed to provide service under this Contract have satisfactory past work records indicating their ability to accept the kind of responsibility anticipated under this Contract. All Contractor’s personnel shall be required to wear uniforms, badges and/or other means of identification which are to be issued and provided by the Contractor and must be worn at all times while working on County property. The County Project Manager must be notified in writing, within seven days of notification of award of Contract, of the uniform and/or badges and/or other identification to be worn by employees prior to beginning work and notified in writing seven days prior to any changes in this procedure.

If any Key Personnel become unavailable or are disapproved and Contractor cannot furnish a replacement acceptable to the State, the State may terminate this Agreement for cause, pursuant to Exhibit A - Standard Provisions, article 3.
Contractor’s Personnel. 3.1 The Contractor agrees that if required by the Authority it will submit any person employed by the Contractor or its sub contractors to the Authority’s security vetting procedure. The Contractor further agrees that unless the Authority agrees otherwise in writing any individual who refuses to submit to such vetting procedure or who does not attain the requisite clearance will not carry out any work on the Services supplied under the Contract.
3.2 Whenever requested to do so by the Authority in writing the Contractor shall within five Working Days provide a list of the names and addresses of all persons who may at any time require admission to the Authority’s Premises in order to provide the Services. This list will include any such persons employed by or under the control of the Contractor’s consultants, agents or sub-contractors. The Contractor shall specify the role of each person on the list and provide such other particulars as the Authority may reasonably require.
3.3 The Authority reserves the right to refuse admission to the Authority’s Premises to any person employed by the Contractor or its consultants, agents or sub-contractors whose admission would, in the reasonable opinion of the Authority, be undesirable.
Contractor’s Personnel. (1) The Authority reserves the right to refuse to admit to the Authority’s Premises any person employed by the Contractor or its sub-contractors, whose admission would be undesirable in the opinion of the Authority.
(2) If and when requested by the Authority, the Contractor shall provide a list of the names and addresses of all persons who may at any time require admission in connection with the performance of the Services to the Authority’s Premises, specifying the role in which each such person is concerned with the Contractor and giving such other particulars as the Authority may require.
(3) If and when requested by the Authority, the Contractor shall procure from each person identified by the request, a signed statement that he understands that the Official Secrets Acts 1911 to 1989 applies to him both during the carrying out and after expiry or termination of the Contract and that he will comply with the provisions of those Acts in so far as they apply to the work he is performing under the Contract.
(4) If and when requested by the Authority the Contractor agrees that it will submit any person employed by the Contractor or its sub contractors to the Authority’s security vetting procedure. The Contractor further agrees that any individual who refuses to submit to such vetting procedure or does not attain the clearance it affords will not carry out any work on the Contract which the Authority certifies as suitable only for people who have passed its security vetting procedure.
(5) If the Contractor fails to comply with paragraph (2) (3) or (4) of this Condition and the Authority decides that such failure is prejudicial to its interests, the Authority may immediately terminate the Contract by notice in writing to the Contractor, provided that such termination shall be without prejudice to any accrued rights of, or to any rights that shall accrue thereafter to, the Authority.
Contractor’s Personnel. The Contractor’s Personnel shall be appropriately qualified, skilled and experienced in their respective trades or occupations. The Engineer may require the Contractor to remove (or cause to be removed) any person employed on the Site or Works, including the Contractor’s Representative if applicable, who:
(a) persists in any misconduct or lack of care;
(b) carries out duties incompetently or negligently;
(c) fails to conform with any provisions of the Contract; or
(d) persists in any conduct which is prejudicial to safety, health, or the protection of the environment. If appropriate, the Contractor shall then appoint (or cause to be appointed) a suitable replacement person.
