Common use of Copayment Clause in Contracts

Copayment. is any copayment, deductible, coinsurance, and/or amounts in excess of the maximum benefit for which a Member is financially responsible in connection with the receipt of Covered Services, as specifically described in the Health Services Contract and/or Evidence of Coverage applicable to the Member and in effect as of the date of service. Any other amount which Provider may seek to recover from Members for Covered Services constitutes a surcharge and is prohibited by both this Agreement and the Xxxx-Xxxxx Act.
