COST ACCOUNTING STANDARDS. ELIGIBILITY FOR MODIFIED CONTRACT COVERAGE If the offeror is eligible to use the modified provisions of 48 CFR 9903.201-2(b) and elects to do so, the offeror shall indicate by checking the box below. Checking the box below shall mean that the resultant contract is subject to the Disclosure and Consistency of Cost Accounting Practices clause in lieu of the Cost Accounting Standards clause. [ ] The offeror hereby claims an exemption from the Cost Accounting Standards clause under the provisions of 48 CFR 9903.201-2(b) and certifies that the offeror is eligible for use of the Disclosure and Consistency of Cost Accounting Practices clause because during the cost accounting period immediately preceding the period in which this proposal was submitted, the offeror received less than $50 million in awards of CAS-covered prime contracts and subcontracts. The offeror further certifies that if such status changes before an award resulting from this proposal, the offeror will advise the Contracting Officer immediately.
COST ACCOUNTING STANDARDS a. Seller shall comply with Cost Accounting Standards set forth in AMS 3.2.3-2, 3.2.3-3 and 3.2.3.-5. when specifically incorporated by the Purchase Order.
b. The Seller shall indemnify Xxxxxx from any liability, cost, , including all legal expense, or price adjustment which Xxxxxx , including all legal expense, or price adjustment which Xxxxxx experiences under these clauses as a result of Seller’s failure to comply with the provisions of the above clauses. In the event that a determination is made that the Seller has failed to comply with any of the applicable Cost Accounting Standards, Rules, and Regulations or has failed to comply with any disclosed accounting practice as submitted in a Disclosure Statement and that as a consequence of such determination the Xxxxxx Contract price or cost is reduced, Xxxxxx shall in turn reduce Seller’s Purchase Order price by a corresponding amount. In the event the Seller disagrees with the determination, and if the Seller (1) timely requests Xxxxxx to appeal from such determination under the “Disputes” clause of the Prime Contract and (2) timely furnishes to Xxxxxx reasonable grounds for taking such appeal, then Xxxxxx agrees, to the extent the Prime Contract allows and at the Seller’s expense, to appeal from such determination in the Xxxxxx name and on Seller’s behalf pursuant to the “Disputes” clause of the Prime Contract. The decision rendered on any such appeal shall be final and binding as between the parties hereto. In the event that final payment has already been made to Seller for the Purchase Order in question, the Seller is required to repay to Xxxxxx the amount of the adjustment within thirty (30) days after receipt of Notice of such adjustment by Seller. Failure to repay said amount within thirty (30) days shall subject Seller to payment of interest based on the then prevailing legal interest rate.
c. The applicable Cost Account Standards clauses shall be inserted by the Seller in all negotiated lower-tier Purchase Orders exceeding seven hundred thousand dollars ($700,000) except for negotiated subcontracts otherwise exempt from the requirement to include a CAS clause as specified in 48 CFR 9903.201-1.
COST ACCOUNTING STANDARDS. A. (Applicable if this contract incorporates clause H001 or 3050). The version of FAR 52.230-2, Cost Accounting Standards, incorporated by clause H001 or 3050 is the version dated April 1998.
B. (Applicable if this contract incorporates clause H002, 3051, or 3067). The version of FAR 52.230-3, Disclosure and Consistency of Cost Accounting Practices, incorporated by clause H002, 3051, or 3067 is the version dated April 1998.
C. (Applicable if this contract incorporates clause H003 or 3065). The version of FAR 52.230-4, Consistency in Cost Accounting Practices, incorporated by clause H003 or 3065 is the version dated August 1992.
D. (Applicable if this contract incorporates clause H004 or 3066). The version of FAR 52.230-5, Cost Accounting Standards–Educational Institution, incorporated by clause H004 or 3066 is the version dated April 1998.
COST ACCOUNTING STANDARDS. Section I of this solicitation may contain the three Cost Accounting Standards clauses at FAR 52.230-3, 52.230-4, 52.230-5, and/or 52.230-6. The resultant contract will contain only those clauses required based on the Offeror's response to the Section K certification titled Cost Accounting Standards Notices and Certification (National Defense).
COST ACCOUNTING STANDARDS. Unless exempt under 48 CFR 9903.201-1 and 9903.201-2, Contractors must comply with FAR 52.230-2, Cost Accounting Standards. In accordance with FAR 52.230-1, Cost Accounting Standards Notices and Certification, Contractors shall notify the ACO and designated OCO on individual Orders, in writing, if there are any changes to the Disclosure Statement and provide the reason(s) for the change. In accordance with FAR 52.230-6, Administration of Cost Accounting Standards, and FAR 52.230-7, Proposal Disclosure-Cost Accounting Practice, Contractors shall notify the ACO and designated OCO on individual Orders, in writing, if there are any changes to Cost Accounting Practices and provide the reason(s) for the change. Under this clause and provision, the “Cognizant Federal agency official (CFAO)” is the same as the ACO identified in Section G.3.3.
COST ACCOUNTING STANDARDS. Cost Accounting Standards, as set forth FAR 52.230-2, are hereby deemed to be applicable to this Subcontract.

COST ACCOUNTING STANDARDS. Unless the face of this order indicates it is exempt from Cost Accounting Standards provisions, the following provisions apply:
COST ACCOUNTING STANDARDS. When applicable, Seller shall comply with Public Law 91-379 dated August 15, 1970 and all of the rules, regulations and standards prescribed by the Cost Account Standards Board. Xxxxxx agrees to indemnify and hold AMI free and harmless from any and all liability, loss or damage arising out of failure of Seller, or Seller's subcontractors, if any to comply with said law, rules, regulations or standards, as the same may be revised or amended form time to time.
COST ACCOUNTING STANDARDS. In compliance with federal guidelines, all non-department of Defense CONTRACTS shall comply with sections of the Cost Accounting Standards (CAS). Therefore, in the Code of Federal Regulations, Title 48, Chapter 99, specifically 9903.2, 9904.401, 9904.402, 9904.405, and 9904.06 will apply to all DEPARTMENT CONTRACTS.
