Costs of Compliance with Emergency Principles and Procedures. In accordance with each Party’s OATT, Transmission Service Guidelines, or other agreements, each Party shall bear its own costs of compliance with this Article. Nothing in this Agreement shall require a Party to purchase emergency energy if the Party cannot recover the costs under an OATT, its Transmission Service Guidelines, or other agreement or lawful arrangement. Notwithstanding any other provisions of this Agreement, PJM acknowledges that TVA cannot sell energy, including emergency energy, to any entity that is not an authorized purchaser under the Tennessee Valley Authority Act. Any such sale shall be provided to eligible Third Parties under separate agreements.
