Common use of CPUC and CEOB 206 Complaints Clause in Contracts

CPUC and CEOB 206 Complaints. Within forty- five (45) calendar days following execution of this Agreement, the CPUC and the CEOB shall file a motion consistent with the terms of this Agreement for partial dismissal of the CPUC and CEOB 206 Complaints effectuating the releases and withdrawals with prejudice of any and all Claims, Liabilities and proposed remedies, or other relief sought insofar as they pertain to the El Paso Releasees, as specified in this Agreement; provided, however, that (i) such dismissal shall be contingent upon the settlement becoming effective, and shall be void ab initio if the Effective Date never occurs, and (ii) El Paso shall so stipulate in a writing to be filed with such motion.
