Common use of Criminal and Legal Liability Clause in Contracts

Criminal and Legal Liability. An employee who is charged in a criminal matter arising out of his/her employment and who is subsequently found not guilty, the charges are withdrawn, he/she is discharged at the preliminary hearing or the prosecution is stayed, shall have his/her reasonable legal fees paid by the Employer. This does not apply where the person has been justly disciplined for a willful act or omission leading to the criminal charge.
