Criminal Records Bureau. 19.1 The Contractor shall not engage persons in the provision of the Services that have convictions or cautions that would render them unsuitable to carry out the duties provided for in this contract. 19.2 The Contractor shall comply with the requirements of the DTV Probation Trust’s Vetting Policy 29th September 2010 in relation to the provision of the services. 19.3 The Contractor shall be required to maintain current, accurate and adequate records of all persons who are to be engaged in providing the Service for a period of 5 years from the termination of the contract. 19.4 The Contractor shall upon reasonable request by the Trust’s appropriate officer provide to that officer in good faith, details including full name, address, date of birth and place of birth of any employee or operative whether directly employed by the Contractor or otherwise engaged by them to perform the contract or any part of the service contract provision and shall do so within 14 days of any such request for the purpose of enabling the Trust to carry out a criminal records check pursuant to the provisions of Part V of the Police Xxx 0000. 19.5 Where, following a check under clause 19.4 above, a criminal conviction certificate is obtained by the Trust following either a standard or enhanced criminal records bureau check and the nature of the listed previous convictions leads the Trust to the reasonable conclusion that the person who was checked is unsuitable to perform the service specified in the contract, then upon the Trust giving notice to the Contractor, they shall upon receipt of that notice remove the person considered as unsuitable from the contract service or where the person has not at that time started to perform the contract service the Contractor shall act so as to stop that person from performing the service. The Trust is not under any obligation to disclose the results of any criminal records bureau check.
