CSXI’s Responsibility. CSXI will interchange in-bond containers to CSX L’s motor carrier in accordance with the appropriate trailer/container interchange agreement during normal business hours at such times and places as shall be mutually agreed upon between the parties. CSXI shall be responsible for any duties or fines arising from Customs violations actually and directly caused by the negligence or intentional misconduct of CSXI during the period the in-bond Containers are in its or its agent’s possession and control. CSXI’s Responsibility. CSXI will, upon confirmation of Customs clearance, interchange a Container to APL's/LTS' motor carrier or its agents or employees in accordance with the relevant interchange agreement during the Terminal's normal business hours. CSXI shall be responsible for any duties or fines arising from Customs violations actually and directly caused by CSXI during the period in-bond Containers are in its or its agent's possession and control. CSXI agrees not to open any APL or LTS in-bond Containers without U.S. Customs Service supervision and approval, except in a force majeure condition or other emergency, such as a leaking Container, or with APL or LTS' permission.

  • Customer’s Responsibility The policies in this document apply to the use of Data by Customers, Redistributors and their End Customers. Customers are responsible for compliance with this policy by all members of the Customer’s Group and by all persons to whom they distribute Data where authorised to do so. Turquoise recommends that Customers make this Schedule available to all Subscribers to their services having access to Data which is subject to Charges, reporting requirements or usage restrictions.

  • Engineers Responsibility The Engineer shall be responsible for the accuracy of its work and shall promptly make necessary revisions or corrections resulting from its errors, omissions, or negligent acts without compensation. The Engineer will not be relieved of the responsibility for subsequent correction of any such errors or omissions or for clarification of any ambiguities until after the construction phase of the project has been completed.

  • Customer Responsibility You agree that you are responsible for all access to and use of the Service through your account or password(s) and for any fees incurred for the Service, or for software or other merchandise purchased through the Service, or any other expenses incurred in accordance with the terms of this Agreement. You agree that you are responsible for backing up (a) any data you submit, receive or transfer over the Service, including, without limitation, your email; and (b) any data, files, programs, or applications on any device you connect to the Service. You acknowledge that you are aware that content accessible on or through the Service may contain material that is unsuitable for minors (persons under 18 years of age). You agree to supervise usage of your account by minors. You ratify and confirm any obligations incurred by a minor using your account.

  • Your Responsibility You are solely responsible for the quality, completeness, accuracy, validity and integrity of the image. You are solely responsible if you, intentionally or unintentionally, submit fraudulent, incorrect or illegible images to us or if Mobile Deposit is used, by authorized or unauthorized persons, to submit fraudulent, unauthorized, inaccurate, incorrect or otherwise improper or unusable images to us.

  • Repair Responsibility Cracks exceeding 1/4 inch in width or 1/4 inch in vertical displacement will be repaired by patching or other remedies.
