Customer’s Additional Obligations. For each ICA Program, Customer agrees to: a. comply with any additional or different terms in its Licensed Program Specifications or an Attachment or Transaction Document; b. ensure that anyone who uses it (accessed either locally or remotely) does so only for Customer’s authorized use and complies with IBM’s terms regarding ICA Programs; and c. maintain a record of all copies and provide it to IBM at its request.

Customer’s Additional Obligations. The Customer must not: (a) deal with this Irrigation Right in any manner contrary to the terms of this Irrigation Right; (b) wrongfully take, use or divert any water from the Scheme except with the prior express written consent of the Water Entity or cause (or allow to be caused) any damage to any part of the Scheme; (c) fail to pay to the Water Entity, as and when required under this Irrigation Right, such rates, fees and charges that are payable by the Customer; (d) fail to allow the Water Entity, its officers, servants, contractors and agents access to the land where the water taken under this Irrigation Right is to be used at all reasonable times for the purposes of inspection, construction or maintenance of the Scheme or any of the Water Entity’s infrastructure not forming part of the Scheme, or for performing the Water Entity’s role in relation to the Irrigation District; or (e) fail to comply at all times with the Scheme By-Laws and the provisions of this Irrigation Right.
Customer’s Additional Obligations. 6.1 General (a) comply with all applicable laws, treaties, regulations and codes of practice that apply from time to time in relation to the purchase or operation of the Product; (b) obtain and maintain any licenses, permits, or approvals required from time to time for the purchase and operation of the Product; (c) use the Product in accordance with the Documentation and, for so long as the Product is used, maintain it in accordance with with the Documentation; and (d) use the Product with consumables and accessories designated by GreyScan as ordinarily being suitable for the Product, and must ensure that all Operators do so. Customer agrees that if the Product is used with any consumable that has not been certified by GreyScan as having been batch tested for compatibility with the Product (whether or not also designated by GreyScan as ordinarily being suitable for the Product) then, to the extent permitted by law, GreyScan will not be liable for any failure of the Product to operate correctly where caused by that consumable (whether due to a change in consumable design, a consumable manufacturing flaw or otherwise).
Customer’s Additional Obligations. The Customer undertakes to: a) provide correct information on their particulars, age, residence address, and possession of legal requirements allowing them to drive; the Customer also undertakes to provide the Lessor their telephone number and electronic mail address in order to ensure that the Lessor can contact them for the purposes foreseen by this contract; b) drive the vehicle and preserve it together with the accessories supplied, diligently and in respect for all provisions of law; c) ensure that ordinary maintenance is performed on the vehicle and perform checks and any adjustments of the levels of all lubricants, the brake oil and check the tire pressure; d) make payment of any fines inflicted on the rented vehicle, highway tolls and any parking charges of any kind during the rental period, and reimburse the Lessor for any third party charges, in addition to the penalty foreseen by the Special Conditions; that penalty has the aim of discouraging the commission of violations and favoring respect for the rules of road circulation and protection of the rented vehicle, and does not substitute the administrative sanction, cost of tolls and/or parking fees that are requested of the Customer by the tax authorities; the penalty will be reimbursed to the Customer against presentation of proof of payment of the fine, toll and/or parking fee, or upon demonstration of annulment of the sanction or in any other case it is not charged pursuant to law; e) indemnify the Lessor from any claim brought by third parties for damages caused to transported goods owned by the same or that in any case are located in the rented vehicle; f) verify and sign, at the moment of return of the vehicle, the “Final Vehicle Inspection” form indicating the condition of the vehicle at that time; failure to sign the “Final Vehicle Inspection” form will prevent the Customer from subsequently challenging any damages charged; g) sign the specific form in which they expressly state that they have not suffered or caused any accidents, even minor ones, in order to allow the Lessor to protect its rights against fraud or unjustified requests; h) return the vehicle to the same place and by the date and time indicated in the rental agreement, with the same accessories present at the moment of delivery and in the same condition as it was received; i) pay a supplement in the case of a “one-way trip”, should the vehicle be returned to a station other than the point of departure; l) return the vehicl...

Part C4 – Rental of Equipment Terms The terms and conditions of this Part C4 (clauses 31 – 37) will only be applicable to any Contract involving the rental of Equipment from JET to the Customer (irrespective of whether or not any separate charges are payable for such rental). 31.1 JET will rent the Equipment to the Customer for use at the Event Premises subject to the terms and conditions of this Contract. 31.2 JET will not, other than in the exercise of its rights under this Contract or applicable law, interfere with the Customer's quiet possession of the Equipment.

Customer’s Additional Obligations. EQUIPMENT 35.1 The Customer will during the Rental Period and until the Equipment is returned to JET: 35.1.1 ensure that the Equipment is used only for the purposes for which it is designed and the purposes for which it is rented to the Customer; 35.1.2 ensure that the Equipment is operated by its staff in accordance with any operating instructions produced by the manufacturers of the Equipment; 35.1.3 ensure that the Equipment is operated by its staff in accordance with any instructions provided by JET; 35.1.4 maintain at its own expense the Equipment in good and substantial repair in order to keep it in as good an operating condition as it was on the date that JET physically delivered the Equipment to the Customer (fair wear and tear only excepted) and will make good any damage to the Equipment; 35.1.5 make no alteration to the Equipment and will not remove any existing component(s) from the Equipment without the prior written consent of JET. Title and property in all substitutions, replacements, renewals made in or to the Equipment will vest in JET immediately upon installation; 35.1.6 keep JET fully informed of all material matters relating to the Equipment; 35.1.7 at all times keep the Equipment in the possession or control of the Customer and keep JET informed of its location; 35.1.8 permit JET or its duly authorised representative to inspect the Equipment at all reasonable times and for such purpose to enter upon any premises at which the Equipment may be located, and will grant reasonable access and facilities for such inspection; 35.1.9 not, without the prior written consent of JET, part with control of (including for the purposes of repair or maintenance), sell or offer for sale, or lend the Equipment; 35.1.10 not do or permit to be done any act or thing which will or may jeopardise the right, title and/or interest of JET in the Equipment; 35.1.11 not suffer or permit the Equipment to be confiscated, seized or taken out of its possession or control under any distress, execution or other legal process, but if the Equipment is so confiscated, seized or taken, the Customer will notify JET and the Customer will at its sole expense use its best endeavours to procure an immediate release of the Equipment and will indemnify JET on demand against all losses, costs, charges, damages and expenses incurred as a result of such confiscation; 35.1.12 not use the Equipment for any unlawful purpose; 35.1.13 as required by JET, ensure that at all times the Equipm...

(ii) Within 48 hours after the occurrence of any loss, theft or destruction of, or any damage to, the Equipment (other than accidental damage that occurs during the normal use of the Equipment in the presence of an employee of Customer), Customer will complete some form of formal written report, and will deliver a complete copy of the report to Company. Additionally, Customer will promptly provide to Company all documents and records Company requests and will provide to Company all other assistance Company requests.
