Customizations. 5.1 The Provider and the Customer may agree that the Provider shall design, develop and implement a Customization or Customizations in accordance with a specification and project plan agreed in writing by the parties. 5.2 All Intellectual Property Rights in the Customizations shall, as between the parties, be the exclusive property of the Provider (unless the parties agree otherwise in writing). 5.3 The Customer acknowledges that the Provider may make any Customization available to any of its other customers or any other third party.
