Common use of CUTTING AND PATCHING Clause in Contracts

CUTTING AND PATCHING. 3.12.1 The Design-Builder will be responsible for all cutting, fitting or patching required to complete the Work or to make its parts fit together properly. 3.12.2 The Design-Builder will not damage or endanger a portion of the Work on fully or partially completed construction of the Owner or separate contractors by cutting, patching or otherwise altering such construction, or by excavation. The Design- Builder will not cut or otherwise alter such construction by the Owner or a separate contractor except with prior written consent of the Owner and such separate contractor. Such consent will not be unreasonably withheld. The Design-Builder will not unreasonably withhold from the Owner or a separate contractor the Design- Builder’s consent to cutting or otherwise altering the Work.
